i'm also concerned about the fact na walang license ang driver. im pretty sure ang daming ngayon ang lalakas ng loob mag maneho ng walang lisensya. kulang sa enforcement tapos isa pa ang pag issue ng license is somewhat turned into a joke. noong araw malimutan mo lang inadvertently yun license mo aligaga ka na mag drive.

Another issue pa is license plates - since that mishap with the LTO supplier a few years back na walang maissue na plaka due to production backlog, wala nang enforcement. Kasi nga naman, hindi nga kasalanan ng car owner yun, pero inaabuso na ngayon.
Minsan nga sobrang obvious na luma na yung conduction sticker (and the car itself) pero yung temporary plate w/ the conduction sticker details pa riin nakalagay... probably kasi ayaw ng owner yung last digit nung naissue sa kanya kaya hindi pa rin kinakabit for as long as they can. Then there are those with fake official plates pa (No 8 para tongressman kuno)...

Speaking of accidents, I was rear-ended by an Innova before the the flyover at EDSA-Boni Serrano NB. All the time na dumadaan kami laging may enforcers doon but that time, of all times, wala ni isa.
Yung dent sa tail gate is hindi naman ganun kalala pero based on my previous experience (nabagsakan ng sanga ng puno), hindi na sya kaya ibalik 100% thru PDR. Pareho kaming nagmamadali at may hinahabol na appointment kaya nagpalitan na lang kami ng contact details. Turned out, yung sakay pala ng nakabangga sakin is a Deputy Director General of a government agency at yung sasakyang gamit nila is carpool ng Malacañan. He offered na i-file ko na lang daw as own damage at sya na sasagot lahat ng gastos. Should I accept his proposal? Also, planning on changing insurance provider na rin this December since matatapos na yung car loan ko sa November.

baka naman mas malaki pa ang participation fee kaysa actual charges that the pintor and lateroman will charge.
i do not know what the usual usapan is, between the insurance providers of the affected vehicles.
but if the other party is paying for my participation fee, and my insurance is going to do the repair, and at no additional expense from me...
i would probably accept the proposal, provided it comes with the cash on the barrelhead at the time of the handshake..

Pwede, no black and white, abot nya lang cash sau, and you have to declare a different circumstance sa insurance, like say hit and run, otherwise baka ma technical ka kung may waiver no matter how small the amount relative to the damage. May mga kaso na ng ganyan dito, nagpa areglo, nalaman ng insurer, ergo nag claim ka na sa other party so denied ka na sa kanila

Based from my previous experience doc, nung nabagsakan ng sanga ng puno ung tail gate ko rin at pina-assess sa PDR, di na maibabalik 100% thru PDR ung tama nya. Di sya yung lumubog lang na nag-curve eh. May 4 dimples at sa may line lumubog.
I plan on filing to my own insurance po. Masulit ko na rin ung 4 years na binayad kong insurance premium.

both vehicles had working breaks and conscious drivers with good vision, and, presumably, legitimate driver's license.
what about "right of way" ?
in my opinion, the motorcycle clearly had right of way, because it was going straight.
the innova was turning. arguably, it did not have right of way.
a road authority once said, "if you have to use your signal lights, then you do not have right of way".
Kaya pala madami di gumagamit signal lights! Haha

While I think the principle behind this is correct - that a vehicle should yield to the other vehicle that has right of way, would this apply if the vehicle that otherwise would not have had right of way... was already in the process of almost completing the maneouver they were attempting?
For example, 100 meters ahead, a car pulls out of a driveway and is already halfway into the main road, would it be right then to not slow down or stop, simply because the car that was merging into the flow of traffic was not the one going straight? Parang di naman tama ata yun. Even if one would be able to later claim that they had right of way in the ensuing accident, it would not be the smartest thing to do.
I agree. It's not as simple as gumamit ka ng signal light. Kung tulad nung Innova na papasok na ng parking lot ng grocery, kahit naka signal lights pa Innova at straight yung MC, hindi na tamang sumingjt pa sa gutter yung MC just to claim his right of way. If you look at the picture malapit na makapasok yung Innova, more than half way na sya crossing the lane, yung MC mukhang sa gutter na dumaan.
