Hindi pwede kasi criminal liability is a personal and criminal action with criminal intent or conduct. Conduct means an action or omission and its accompanying state of mind (intent).

The intent part is the one that will ultimately determine culpability. If for example wala ka helmet pero nasa proper lane pero mabilis magpatakbo, tapos ang kasalubong mo lasing at siya bumangga sa iyo? Lusot na may kasalanan talaga. Reckless driving ka naman, wala helmet, pero the proximate cause.of the problem is not youra diba, nasa kabila. Kaya hindi pwede yung ganung assumption.

Not wearing a helmet for example is a civil offense against the state. A criminal act is an offemse against society and the state. So mas matimbanh yun. The former will entail an administrative penalty, the latter calls for punitive sanctions like imprisonment, fine or both.
