December 15th, 2006 08:45 PM #1492I just got our problematic Dmax LX from the casa - so far so good....the check-engine and rpm drop doesn't seem to exist.
And guess what, we did not pay a cent. I guess Isuzu knew that we were serious with filing a case against them plus they also knew that our claim was a valid case (except for that stupid engineer who refuses to admit it).
Naawa ako tuloy kay sir (col.) paul chua...on his trooper...sana sampahan na lang nya ng kaso ang Isuzu para seriosohin sya.
Para sa curious, the behind the scenes of this case are:
1) Wednesday last week, they advised us (thru casa) that the engineer of isuzu finds the fault on our dmax was due to our neglect of use (ecu was damaged by flash-flood). So no warranty can be claimed. They even faxed us a P44K plus worth na quotation for a new ecu.
2) I called up my boss in cebu, told the findings...we reiterated that the problem started to occur already even before the flash-flood. So we think the problem was with the dmax. My boss called up his cousin who is with isuzu cebu...he also agreed that our case is/must be a valid claim. He also added that the ecu is SEALED and even if ecu of the dmax gets under water, the car would still work properly.
3) Friday, my boss relayed this information to Ms Ana Dalida of isuzu (customer care daw). She insisted on their engineers' claim - neglect of use. So we said we are filing a case with our lawyer.
4) Saturday morning (Dec 9) we faxed them a demand letter of claim coming from our lawyer (btw we also claim a business loss of P1M for every month that the vehicle could not be used and we are going to claim this against them (should we win the case)). Also on thatday, sabi ng casa I can pull out the vehicle anytime (kung hindi pa namin ipapagawa).
5) Come tuesday, I visited the casa to pull-out the vehicle, eto na si casa..."sir hindi pa pede mailabas kasi nainstall pa lang ang bagong ECU, under test pa". Then I learned that nuong monday, they were advised by Isuzu plant to replace the ECU na on grounds of waranty claim....napa ngisi ako.
6) Eto pa, the casa was going to charge me some labor, fuel (for testing) and toll fees (kasi they tested it on the nlex). I told the casa, I thought it was part of the waranty claim?!? E madahilan pa, so sabi ko sige ifax nyo nalang muna yung copy ng breakdown nung amount (about 3K din kasi)...and relayed it to my boss.
7) Tawag boss ko kay ms Ana dalida (nasa meeting daw - parang nagtatago na) kaninang umaga...so sinabi nila yung problem sa kasamahan ni ms dalida - bakit kami sisingilin e waranty claim nga yun and the gas, toll fee and reprogramming of the ecu is part of that.
8) Wala pang isang oras, nagtext casa, sir pede na kunin dmax nyo. I called them up, papaano yung babayaran?....wala na sir ang sabi, covered na sa waranty...
