Well, whoever prepared the affidavit and signed it is immaterial since the person who executed it is dead. It's a useless piece of paper as far as evidentiary rules are concerned. They should have done perpetuation of testimony under Rule 134.

Maybe they'll blame Espinosa's death on De5 instead.
