    Since usapang Lupa na din Atty. ask ko lang may habol pa kaya ako dito

    Meron ako na bili lupa sa subdivision na transfer na sakin ang tittle pero pinag katiwalaan ko na mag tago ng tittle ibinenta sa iba ng hindi ko alam. Nag nag trace ako sino naka bili sabi nya sakin may nag pa kilala daw na sya yung ako.. so basically na peke ang pirma ko at na peke din ang identity ko. Since na abroad ako during that time hindi ko alam na matagal na pala na benta ang lupa.. nalaman ko lang ng balak ko na patayuan ng apartment sabi ng kapitbahay eh iba na daw may ari.. Ayon nag ka bukuhan na binenta pala ang lupa ko.. Hindi ko na asikaso habulin kasi lagi ako out of the country. 165 sqm yung lupa 5 years ko din yata hinulugan yon noon. nawala lang parang bula.


    Pwede ko pa kaya ma bawi yon? may copy pa ako ng tittle na naka pangalan sakin. last time na nag verify ako sa RD na transfer na talaga sa naka bili kaya ko na trace at na puntahan yung bumili..sya din nag sabi na may nag pakilala na tao sya yung tao naka lagay na owner sa lupa..

    yes, unless prescription or principle of estoppel or laches is applicable.
    there is a legal maxim apt to your case: Nemo Dat Quod Non Habet-- nobody can dispose of which he does not have. the supposed "buyer" who bought the property from your katiwala who forged your signature and impersonated you could not have acquired better title of your property than what your katiwala had when he (katiwala) sold it to him (buyer). in other words, the water cannot rise above its source.

    so matagal na process ang iniisip ko kasi is it worth na habulin ko pa ba? or ipag pa sa dyos ko nalang?

    civil case will drag for years, yes, but a 165 Sq. m. property, in MM, or in any urban areas, is worth it. who knows the defendant will settle during mediation. and, if you have a right, you fight for it. it's not about inconvenience or expense, it's about vindication, it's about justice.

    ^who knows, si liz taylor yata got married 7 times, at nagpakasal kay richrad burton twice. and problema dito sa batas natin naging very expensive yung annulment or declaration of nullify of marriage.
