under the civil code, a special power attorney is actually a contract of agency. By the contract of agency a person binds himself to render some service or to do something in representation or on behalf of another, with the consent or authority of the latter. (Article 1868 )
Agency is extinguished by the death, civil interdiction, insanity or insolvency of the principal or of the agent (Art. 1919).
in other words, SPA has already been extinguished upon the death of the principal. so whatever contract the agent entered into by reason of that SPA is an unenforceable contract.
under the civil code, unenforceable contract is entered into in the name of another person by one, who has been given no authority or legal representation.
