i have been in the legal profession long enough to acquire the experience, skills, and practical know-how in the intricacies of the law to give advice on legal matters that i may deem i have the competence to render. so to those tsikoteers (not trollers) who have friends who are in dire need of a legal advice post it here and I'll oblige to respond to the best of my ability. anything connected with criminal law i think i am competent and a little about civil law especially in the fields of persons and family relations, property, and succession. commercial or mercantile, labor, and tax laws i don't profess i have the competence nay the expertise. my only intention here is to help and to share to this community the things that i learned through the years. lawyers of this forum your inputs, comments, and views (or constructive criticism) are very much welcome. thank you.

yes, talagang maganda pag usapan yan. by the way, the OSG pala yung mag appear in behalf of the state in annulment and declaration of nullify cases pero almost always for lack of personnel the OSG will delegate its authority to the office of the city/provincial prosecutor to represent the state in its behalf.

OT: look before you leap, esp with this issue. minsan nadadala lang tayo ng pride at emosyon natin. had my marriage annulled after 15 years with my wife, went single again for the next 8 years, then remarried my ex-wife again.. it cost me money, family problems dealing with the kids. everything seems to be out of order. after i remarried my wife, i found new meaning in living because i realized how stupid i was.. think twice before considering it. hope this helps.

may problema kami sa mother tittle ng lupa namin sapilitang kinuha sa amin ng pinsan namin ung titulo.ngayon pinasukat na namin ang kani kaniyang lupa,,sukat na lahat.papa titoluhan na ng bago under sa pangalan ng nanay namin kasi nga pamana lang sa amin ng aming lolo un..

ngayon kinukuha na namin ung mother title sa pinsan namin at ang sagot nila hindi daw nila alam kung nasaan ,,

thanks bro. para sa bayan ☺ ang sa akin mas madali mag bigay ng payo kung I'm using my Mac rather than this Note3. the thing is, di ko pa alam masyado paano gamitin yung Mac in relation sa tsikot. parang mabagal eh. unless you give me an idea how 😀 you know it's somewhat difficult for old dogs to learn new tricks

Attorney just open your browser and type tsikot.com in you mac, mac is using opera browser if not mistaken but you can always download chrome or other browsers, i think its allowed.

Btw, meron din akong gustong itanong total regarding legal advise sa lupa ang tanong, my Father owns a property in Bicol we as his children are the rightful heirs to the property, last December I came to know that someone we know, not blood related (pinaral at pinalaki nina Erpats, not even legally adapted) sold our property thru an SPA, my question is regarding the validity of an SPA.

Is the SPA still legally binding even if the issuer is already dead from the time the SPA was used?

under the civil code, a special power attorney is actually a contract of agency. By the contract of agency a person binds himself to render some service or to do something in representation or on behalf of another, with the consent or authority of the latter. (Article 1868 )
Agency is extinguished by the death, civil interdiction, insanity or insolvency of the principal or of the agent (Art. 1919).
in other words, SPA has already been extinguished upon the death of the principal. so whatever contract the agent entered into by reason of that SPA is an unenforceable contract.
under the civil code, unenforceable contract is entered into in the name of another person by one, who has been given no authority or legal representation.

kung yung pag squat ay di pa lumagpas ng isang taon file kayo ng forcible entry ng MTCC ng davao. pero kung more than 1 year na yung dispossession, file accion publiciana or accion reivendicatoria. Bahala na korte at ang sheriff ang magpa alis sa kanila. kung totoong well-connected kayo dun ibackchannel nyo kay digong.

^who knows, si liz taylor yata got married 7 times, at nagpakasal kay richrad burton twice. and problema dito sa batas natin naging very expensive yung annulment or declaration of nullify of marriage.
