BF's right because, in criminal law, a person performing a lawful act is exempted from criminal liability under the Revised Penal Code provided that the person performing such lawful act does it with due care and without fault or intention of causing it.
For instance,a person driving within the designated lane and within the allowable speed limit, as imposed by competent authority, is a person performing a lawful act with due care.

pero sana lang talaga matutong magbigay ang pinoy drivers sa pedestrians, jaywalker o hindi. alam naman nating walang panalo ang tao sa auto. sa US, kahit naka-green yong mga sasakyan basta may tumawid na tao titigil sila, patatawirin at hindi bubusinaan. very courteous sa pedestrians. we have to learn how to do that.
as for people who cross right underneath a footbridge, sometimes the local politicians are to blame for that. nakakita na ba kayo ng overpass sa isang 4-lane road, in other words, hindi malapad at hindi busy na kalsada pero nilagyan ng overpass?! bakeeet?!
sa mga tao namang tumatawid sa isang napaka-busy na kalsada sa halip na gamitin ang overpass o underpass, hindi ko sila maintindihan. why would someone risk his entire life just to save a few minutes and calories?

I'm lucky that I've never hit a pedestrian in my entire life although I must admit na napaka one sided yung traffic law natin. Ika nga, the pedestrian is always right. It comes to the point na sobrang daming respsonsibilidad ang nakapatong sa mga motorists eh nakaka paranoid na tuloy mag maneho while sa pedestrians eh parang no obligation ang dating nila.
In the US, pag may nabangga kang pedestrian eh ayun pala tumawid during a green light eh di mo kasalanan... that's the same in London and in Germany na may sang damukal na CCTV cameras na nagbabantay sa inyo 24/7. Kaya if ever may accident na ganun you'll just have to file a report and the surveillance cameras will submit the proof. You will not be liable for damages in fact yung family pa ng victim ang magbabayad sayo for the repairs of your auto pero most of the time eh dini decline nalang ng owner ng auto as a gesture of goodwill kasi gumagastos na nga yung family ng nabundol sa medical eh.
Dito kasi sa Pinas di fair para sa mga motorists. Ikaw na nga ang sumusunod sa batas eh may irresponsableng pedestrian eh ikaw pa ang dehado. Our traffic laws should be fair and just. Kung may rules para and penalties para sa motorists eh dapat lang ganun din para sa mga pedestrians.
OT: I'm not in favor of the 100kmh speed limit ng NLEX. Kaya nga tinawag na EXPRESSWAY eh! Also, it should be regulated only for puvs and buses. Going slower doesn't mean it's safer. Sa Autobahn nga minimum mo dapat doon eh nasa 120kph-140kph... if you go below that hahabulin ka pa ng police at pagsasabihan ka to speed up PERO the Autobahn is officially the safest road in the world. Kinda makes you think.

Now that I am a motorist, I sometimes find myself crossing sa road kung
saan-saan. Sumasabay ako sa maraming tao para talagang hihintuan
ng mga sasakyan. IM GUILTY just like a lot of you people reading this thread.
Di po ba kaya hindi natin ginagamit yung PINK (why the F*** is
it pink??) na overpass na yan eh dahil matarik at mainit at matatagalan
tayo - and guess why are we always rushing/nagmamadali - because
we are always LATE! Filipino time is always on time my ass!
Walang disiplina ang Pinoy. Mamamatay at tatanda na lang tayong lahat
hindi matututo ang Pilipino. Sakit na natin ito na pinilit ding baguhin ni
Jose Rizal - 'cancer' ng lipunan nga daw. The funny thing about this
is we know that kapag ang Pinoy nasa ibang bansa nagiging disiplinado.
So my conclusion is - Walang pag-asang maging disiplinado ang Pinoy sa
Pilipinas. Lalo na sa metro manila.

TAMA! nadale mo sir nice&clean. Kagaya ko din kung saan saan din ako tumatawid dati, but now sa ibang bansa pa ako natuto at naging disiplinado. Coz here in spain kapag nasagasan nila ay wala sa pedestrian lane or naka green yung traffic light means go for vehicle it is not the fault of the driver. This december while on a vacation there aba! nagbago na ako hehehe!, tumatawid na ako sa pedestrian lane, pro yung mga ibang ungas na driver nagagalit pa kapag tumatawid ka sa tamang tawiran na nga, bubusinahan ka pa...mostly mga PUV driver gumagawa non tsk! tsk! idiota!
