    Are the MMDA guys serious? Will the family of the victim agree? Chances are no, even if the motorist is in the right of way once you hit a pedestrian, reckless imprudence resulting to physical injuries will be charged if lucky, if the victim dies then resulting to homicide will be your case.

    Are there any updates on this?

    It may sound cruel, but when pedestrians choose to cross under elevated walkways (and in the case of areas such as the katipunan extension, may wire fences na nga AND elevated walkways), then motorists should no longer be held liable.

    My point really isn't to promote hit and run driving.

    Na-ganiyan na kasi kaibigan ko.

    Friend was driving at 20-30kph along/around commonwealth. Jaywalker (young girl) literally runs into his car - she hit the car doors (how smart can she be?)

    Kaibigan ko pa daw idedemanda ng magulang ng babae. (Family of jaywalkers)

    Buti nalang kumampi sa kaniya yung mga MMDA.

    All the stupid bystanders did was accuse the driver.

    Kung hindi tumulong yung MMDA, he probably would have been in deeper crap than he went through.

    Sa Jaywalkers naman e. Basically jaywalking is illegal. Tapos sa illegal activity na ito, nasagasaan sila ng motorist who is not doing angthing illegal. may kasalanan ba ang motorist?

    Kaya nga may sign board sa ibang lugar: "wag tumawid nakmamatay". What if sa harap ng sign na ito may nasagasaan? Or sa ilalim ng pedestrian overpass?

    At least in these situations, the MMDA actually makes sense. Ang mga pulis kasi natin, walang kaalam-alam sa batas, kaya imbes na maingat na pagsisiyasat sa pangyayari ng kaso, e mag sasampa nalang ng demanda. Even if the PNP files the case for reckless imprudence, the prosecutor would probably dismiss it for lack of probable cause.
