Another company hit by cold reception of windows RT.

Taiwanese computer maker Acer has put back the launch of its Windows RT tablets following mixed reviews for Microsoft's own Surface device which is powered by the new operating system.

Acer said it was now unlikely to distribute the product before April.

One should know when its time to be obedient and stop being an ass. Another bad move by Apple IMO. Talo na nga sa case, hindi pa inayos yung dapat gawin. Yan tuloy, rubbing salt to the injury. Bad karma for strting this infringement lawsuits IMO.

Apple has 48 hours to re-write a statement on its website relating to its design rights dispute with Samsung, UK judges have ruled.

Apple was forced on 18 October to publish a message making it clear that Samsung had not infringed the iPad's registered design.

However Samsung complained the statement Apple had posted did not comply with the court order.

Judges agreed and have told Apple it must be removed within 24 hours.

It just shows the mentality of Apple in general these days - big-headed and immature.

    edit:

here's another bad move by Apple

Apple may have solved their trademark problems in China, but it appears they may have a bigger problem on its hands south of the U.S. border, as a court in Mexico City has denied an injunction that would have allowed Apple to continue to sell under the iPhone brand because it violates the trademarks of iFone, a Mexican telecommunications company. The ruling could have a major impact on Apple’s phone sales in Mexico, as well as affecting the marketing and sales plans of several wireless service providers in the country, some of which were gearing up to offer the iPhone 5 to customers this weekend.

It’s not actually clear what Apple was thinking this time around – the iFone trademark was filed in Mexico in 2003, a full four years before Apple filed to trademark the iPhone. Despite the rather obvious priority issue, Apple decided to sue iFone in 2009 in an attempt to invalidate the company’s name for being too similar to the iPhone. The predictable response was a countersuit by iFone, and the court battles have been swinging in iFone’s favor ever since.

The move could prove costly to Apple in more ways than one. In addition to losing the ability to sell devices under the iPhone trademark in Mexico, iFone is also suing for damages for past infringement, asking for a minimum of 40% of all iPhone sales to date in the Mexican market. While those numbers aren’t nearly as large as they are in the U.S., it still would represent a substantial payment. It's not yet clear whether the embargo on using the iPhone name will go into effect before sales of the iPhone 5 start on Friday, or if this will trigger Apple to loosen the purse strings to negotiate a settlement with iFone, but given the circumstances it would seem that Apple has precious little leverage this time around.

Clearly lawsuits can be a double-edged sword.

Based on actual experience using iPhone 4s (network provided) and S3 (company issued) , ipad2 and galaxy note 10.1, libations pa din ang OS ng iOS compare sa android.

ANDROID???

    here we go again

Apple Inc. told a judge that Samsung Electronics Co. (005930)’s Galaxy Note 10.1 device infringes its patents, and sought to add the Android 4.1 Jelly Bean operating system to an existing lawsuit against Samsung in California.

Apple made the arguments yesterday to U.S. Magistrate Judge Paul S. Grewal in federal court in San Jose. Apple’s bid to expand the lawsuit follows Samsung’s Oct. 1 move to add patent- infringement claims against the iPhone 5 in the same case. Apple won a $1.05 billion jury verdict against Samsung on Aug. 24 in a separate patent case in the same court.

Filings by both companies in their two cases before U.S. District Judge Lucy Koh show no letup in their battle on four continents to retain dominance in the $219 billion global smartphone market.

Samsung in August began U.S. sales of the Galaxy Note 10.1, equipped with a stylus -- a feature Apple’s iPad doesn’t offer, and which builds on Samsung’s Galaxy Note 5.3, a similarly stylus-equipped smartphone that came out earlier this year. Jelly Bean is Google Inc. (GOOG)’s latest version of the Android operating system that runs on Samsung mobile devices as well as Google’s Nexus 7 handheld computer, which was released in June.

Apple To Pay $368 Million For FaceTime Violation

    November 7, 2012

Last night, the Tyler court ruled that Apple had infringed upon VirnetX’s patents and would therefore have to pay $368.2 million to the company. While $368.2 million isn’t a small sum, it’s a small sum to pay for a company who has $123.1 billion of on-hand cash. This reward is also nearly half what VirnetX was originally seeking from the case. They are also still trying to bring a ban on all infringing Apple devices, including every iPhone model and the iPad 1 and 2.

Apple has yet to make a comment on the case, and they still have a right to appeal the decision.

According to VirnetX, Apple’s FaceTime and iMessage services violate their patents which involve establishing a secure communications link. The company also held that Apple should have paid them a licensing fee before using the technology in their Macs, music players, tablets and smartphones.

As a result of this ruling, shares in VirnetX have risen by as much as 23%, according to Bloomberg, the largest intraday increase in nearly 3 years.

“This victory further establishes the importance of our patent portfolio,” said CEO of VirnetX Kendall Larsen in a statement.

According to the BBC, this isn’t the first time VirnetX has won a patent trial against a very large computer company. Previously, VirnetX was able to emerge victorious from a suit against Microsoft over their use of similar patents.

“Apple says they don’t infringe, but Apple developers testified that they didn’t pay any attention to anyone’s patents when developing their system,” explained a lawyer for VirnetX, according to the BBC.

This ruling could also help the company as they seek to have Apple products banned in the States for their alleged violation of these patents.

While Apple has yet to announce an appeal of this decision, one of their lawyers based in Houston, TX has given some pretty strong words during the case.

“Apple does not owe money to VirnetX,” stated Danny Williams, a partner with Williams, Morgan & Amerson, speaking to the jury during the case. “VirnetX is not entitled to money for things they did not invent. The VirnetX technology, if used, is a small part of very large, complex products.”

According to some news sites, however, VirnetX is nothing more than a patent troll who happened to get lucky. VirnetX describes themselves as a holding company, saying: “Our portfolio of intellectual property is the foundation of our business model.”

The company only reported $36,000 in revenue last year from their 45 patents.

The Mac Observer also points out that the East Texas courts are often chosen for these kinds of lawsuits as they often rule in favor of the smaller company and move the cases through quickly.
