Was able to read the majority and dissenting opinions of the case of Enrile vs. Sandiganbayan and all I can say is, WoW!
I have new found respect for Associate Justice Leonen who's dissenting opinion upheld the instances when bail may be granted an accused. I'm wondering, if the SC majority granted Enrile bail on the basis of humanitarian reasons, then why say the Sandiganbayan arbitrarily ignored the intent of bail if all they did was to deny bail on the basis of what was in the Rules of Criminal Procedure and existing jurisprudence?
In an earlier case where the SC granted Enrile the right to a Bill of Particulars, Justice Brion made it more difficult to prosecute those who commit plunder since the information now has to state with particularity how each instance of plunder was committed by the accused. Sheesh! Eh kaya walang makukulong talaga na corrupt jan!
