If my history and short research is correct.
1937 - Japan invaded the whole of South China Sea.
1947 - China marks South China Sea claim - the nine dash line. Was formally 11 dash line.
1951 - Treaty of San Francisco. Japan renounces all claim on South China Sea.
1974 - Beijing builds military installation, airfield and harbor on Woody Island, the largest of the Paracels. Vietnam plants first permanent installation on Spratlys.
1982 - UNCLOS established.
1988 - China sinks 3 Vietnamese ships, killing 74 sailors, one of the most serious confrontation on the South China Sea.
1992 - China passes law on territorial sea.

The problem is really old. China has been at it since 1947. None of us here exist yet. lol
I think we are not the only region with overlapping EEZs. Thank you so much UNCLOS for the overlapping EEZs that created so much conflicts which they also cannot police.
1) Canada and United states: Beaufort Sea
2) Canada and France: Saint-Pierre-et-Miquelon
3) Croatia, Italy and Slovenia: Adriatic Sea
4) Turkey and Cyprus: south of Cyprus
5) Lebanon, Cyprus and Israel: Overlapping EEZ
If you are reasonable wala naman conflict eh. If may pareho kayong claim then hahatiin niyo dapat area.
Simple example ia a strait na 100 kms lang. Since may 2 countries in bith sides, their EEZ will be 50kms only from the shoreline.
I think it is possible to have a compromise sa south china sea basta lahat ng claimants before going to arbitration will agree to respect the decision. Tignan mo China, ayaw naman sumunod kaya useless.
The UNCLOS is a good law but has no teeth because no one country or the UN can enforce it withouth violence.

UNCLOS was merely established in 1982.

By the way, US did not or will never sign the UNCLOS treaty. It remains outside the convention.
It kind of makes you wonder why.
China can also leave UNCLOS if it wishes to. China signed UNCLOS only in 1996.

Mahiya kayo 11 dash line yan before. Nag compromise na ang China, ginawa na lang nilang 9 dash line.

Does the US, Australia or Japan even recognize the claim of PHL over the West Philippine Sea?
In the perspective of China, it is merely protecting its 9 dash line claim (was 11) since 1912 where no countries in South East Asia were even contesting it. South East Asian countries and China were at peace with each other.
Come 1982, when UNCLOS was established and the EEZ ruling took effect, territories began overlapping, with each country asserting its rights according to the problematic EEZ.
While the US refuses to sign the treaty.
So, that's the short of the story.

Problem: How do we resolve the EEZ problem with China in a peaceful manner? We have to take note that we are merely late participants of this territorial claim when UNCLOS was established in 1982.
We have 3 options:
1) Go to war with China with our allies. Kindly note we are not talking about WW2 era weapons. We are talking about advance weaponry and nuclear capabilities on both sides. Severe destruction on our country and the rest of South East Asia.
2) Diplomatic protest till kingdom come, souring ties with China. Worse, cutting ties completely with economic consequences. We will still go to war eventually as it escalates. Same same, only delayed.
3) Peaceful negotiations. You lose some, you win some and get over with it. With economic benefits and friendly ties. Let the US war with China alone to assert open seas. Whoever wins, we will still be at peace with both countries.

sa mga lumang mapa, kasama na sa pilipinas ang scarborough shoal
samantalang napagtripan lang isama nung mga instik (Taiwan) sa mapa nila yung 11 o 9 dash mga 1950s na?
by the way, yung Taiwan may existing claim din ata sa islands sa Batanes
kaya hindi malayong maging probinsya talaga tayo ng china![]()
