    sa tutuo lang hindi ako naniniwalang rape yung nangyari, yes, prolly there was misunderstanding sa huli but i dont believe there was a rape...pero sa kabilang banda ok rin ang nangyari para naman magingat-ingat sila sa pagtrato sa mga kababaihan natin..desente man o pokpok.

    yung paglipat ni smith sa us embassy parang nakakapangliit...talagang nakakahiha minsan itong gobyerno natin...hindi man lang magpaligaw...kahit pakipot lang...grabe!

    If he wants to limit the amount of his dna evidence in her..... Sure, why not? It wouldn't be much of a struggle (and break the condom) if she was out cold.

    What rankles me is that he was probably briefed countless times never to get involved with the local women. Now, he's going to be an example for other GI's. If they weren't listening then. I'm sure they're listening now after seeing what happened to Smith.

    Now GMA admitted that Smith's transfer to the US Embassy has her blessings to save the bilateral relations with the US. Yesterday, his secretaries were saying she had nothing to do with the transfer.

    If Estrada can be detained at his rest house while under trial - why not Smith? If you talk about the gravity of their crimes, Estrada is facing plunder with a maximum penalty of death while Smith is only in for rape for 40 years.

    The repercussion of Smith's custody goes over and beyond our borders.

    Some say that we can "survive" without the Americans but guess who we can turn to should China decide to annex the Spratlys?

    It's quite amusing na madaming galit sa inhumane conditions ng prisons natin. Yet, people still want Smith there. And when he is detained in a facility that is up to the standards of his home country, people think he is being pampered. Oh well, can't please 'em all.

    From the VFA:

    The custody of any United States personnel over whom the Philippines is to exercise jurisdiction shall immediately reside with United States military authorities, if they so request, from the commission of the offense until completion of all judicial proceedings.
    Smith should have been with the custody of the US military from the start.

    From my interpretation, the US military will only have over Smith when the higher courts have made their final decision over this matter.

    The VFA is very vague on this kind of thing (it can be subject to interpretation). Come to think of it, the VFA is vague on a lot of things. Parang minadali din lang kasi during the time of Ramos.

    so, according to what m2 posted, what we have here is the Philippine government honoring the terms of an agreement that both they and the US had agreed to...right? how dare they!

    the other implication is that prejudice against the US/US military/President GMA/the Philippine government/all of the above is more important than knowledge of facts or the provisions of law? this never happens on tsikot.com!! :rofl01:
