Here is hoping for some advice on what to do...
Facts: 1. Jan 6 2016. My 89-yr old mother slipped and broke her hips; hospitalized, doctor suggested a minor operation.
    2. Jan 8, operation was done.
    3. Jan 13, discharged from the hosp tho she could not yet even stand up alone; therapy continued at home with regular check-ups at the hosp.
    4. Operation wound never seemed to heal even after more than 2 months.
    5. March 28. Consulted another Dr; advised re-opening of the wound asap as the 'nana' or pus is threatening to spread, hinting that something wrong was done by the 1st Dr.

Paano po ba at saan pwede magreklamo sa ganitong malpractice?

Thanks for any input . .

it is going to be one doctor's expert opinion vs another doctor's expert opinion. i would rather spend the money for the lawyers on making mom's days memorable and happy. imho, no win situation if you sue.

Yup, did the second doctor said na mali ang ginawa nung nauna? For sure hindi.

Mahirap and matagal na proseso yan.

It might backfire sa inyo, since inuwi niyo na si mother mo and kayo na nag manage sa kanya.

    Thanks po sa replies.
Nway, it was upon the 1st Dr's order that mom was discharged, we never asked nor insisted for it. It was our opinion that this Dr needed to collect his fees (P110k) agad to sustain his casino habit (public knowledge po ito). Siya rin nagrekomenda ng home therapist at sched of hosp checkups.
The 2nd Dr hinted "parang may naiwan sa loob" nung operahan ni 1st Dr.

Arent there any govt agency that may not leave such a case go unheard of? Kahirap naman na scot-free na lang ang mga ganitong professionals...how many more victims kaya ang nabiktima na or mabibiktima pa???

Yes, naisip na rin nga po namin to go to the media. Paano po ba kumontak sa Tulfo bros or any media personality?
Bdway, nangyari po ito sa Laoag City.

As a surgeon myself, I'll chime in. Best way to resolve this is to talk to the surgeon who did the surgery on your moms hip and tell him truthfully that you sought another opinion and it seems that there's infection brought about by something that was left behind during the OR. Honesty is the best way for both surgeon and patient with regards to surgical complications. If the surgeon's level headed, he'll do the proper rectification by either addressing the infection himself or allowing you to have the second surgeon fix it. A great compromise in such situations is that the surgeon will pay part or in full for the second operation, if indeed he is liable for leaving something behind in your moms hip which is "res ipsa loquitur" - the thing speaks for itself. HTH

Meron ako alam isang kaso. Radiologist ba tawag sa mga nagultrasound. Meron patient nagpaultrasound. Nakitaan daw "cancer"

Bigla tinawagan sa cellphone ng radiologist yung patinet to inform na meron "cancer". Nagulat yung patient ano right nung radiologist na tawagan sya to inform. Dapat yung doctor ang magsasabi ng result.

Yun pala meron agenda yung radiologist na irerefer sa kakilala surgeon. Nagsumbong yung patient sa attending doctor nya. Napaka-unethical nung radiologist.

Nagpa second opinion yung patient sa traditonal chinese medicine. Non-cancerous. Magaling na ngayon.

Unethical AND stupid. Did he think the patient wouldn't talk to the doctor?

i found the last statement, "disconcerting".

so how did the patient find out about the radiologist's agenda?

but this story is already "second hand". kuwento ng na-i-kuwentohan... the passage of factual information might not have been "faithful"...

but yes.. the story does not speak well... of the radiologist as well as of the patient.

Not really secondy hand kwento. Hindi ko sya close friend pero sya mismo kausap ko.. Kaya i put it "Meron ako alam isang kaso"

Tinawagan sya gabi sa cellphone nagpakilala yung radiologist. Telling na cancerous at meron na irerefer na surgeon makakadiscount.

Mukhang negosyo na ito nung radiologist. Kunyari makakatulong. Atin atin lang ito.

The last statement you mean sa traditional raditional medicine? Yes doon sya gumaling. Yung attending hospital doctor nya prescribe medicine kaso hindi lumiliit yung problem sa neck nya. So for operation talaga.

Eh ayaw nya maga-opera so someone from his group tell her about a low profile doctor in ongpin st na famous in treating and curing disease.

Even doctors from st lukes, medical city and PGH who practice both western and TCM knew that doctor in ongpin st.

Elevate your concern to the hospital's medical director. Request for a conference. You can bring your lawyer agad if you wish but i suggest pag-usapan nyo muna. Good luck.

First I'm not a surgeon nor a doctor hehehe.

AFAIK, there is always a risk of infection after a surgery. I think it is a matter of preventing it by the surgeon and everything around him to be clean during the surgery and by taking medicines afterwards.

Now the question is where did the first doctor went wrong?
Did the second doctor explicitly said that there was a mistake during the first surgery? This is important because you do not want to provide a hearsay as an evidence.

Anyway, on a related note. My wife's 90 year old grandmother also recently had an operation because of a broken hip suffered from a fall. She was likewise discharged after a couple of days. She did not spend a lot of time in the hospital. Therapy was done in the house. SO far, there no reports of infection.

This is the same thing I was thinking reading the OP.

A doctor will NOT recommend that a patient stay in the hospital for prolonged periods after an operation simply to continue therapy there. This is unnecessary additional expense on the part of the patient.

As soon as a patient is stable and does not need to be observed for bleeding or cardiac problems, they can go home and have therapy done there.

    Ang pagbalik ng comeback...

I dont know if you can win in court. The patient is 89 years old already and very at risk to infection no matter how good, clean and aseptic the operation was. Also, fractures are known not to heal as fast or even completely among geriatric patients. Maybe your first doctor failed to inform you about this but malpractice? I doubt it.

in court, it all boils down to what lieutenant kaffee said in "few good men"--

i dont care what i know; i only care what i can probe.
