    There is no law which automatically attributes fault to any one party in the case of a vehicular accident resulting in death or injury. Its the duty of the police officer to file the case and let the party justify his actions before the prosecutor or in court. In all probability, there will be no witnesses to corroborate the police's allegations of reckless imprudence.

    the problem with motorcycles is that anyone can buy them. motorcyclists should all learn proper road discipline. everyone here knows that its fun to be fast, pero being responsible must always come first.

    badtrip talaga karamihan sa nagmomotor..feeling superman..akala mo hindi madidisgrasya, last month lang..palabas ako ng parking ng school, nakastop lang ako sa labas ng gate kasi may jeep na umaatras, ng paandar na ako biglang may sumalpok sa kotse ko.. un pala un nagmomotor sumemplang at un driver tumama sa gulong ng kotse ko.. ayun bali un right wrist nya at naitukod pag bagsak nya.. ang nangyari kargo ko pa un pagpapahospital sakanya at kailangan lagyan ng bakal un kamay.. nagmagandang loob na nga ako tulungan siya ng bumagsak siya..ang nanagyari pinamuka nya na taga psg sya at kailangan ako pa magpagamot sakanya dahil daw naka tigil ako sa daan kaya kailangan nya magpreno at sumemplang....

    *Papao, nakakainit ng dugo yang ganyan. Iwanan mo sa ospital, kung hindi niya alam ang ginagawa niyang mali kailangan matuto yan.

    O kaya pag magaling na siya, painitin mo yung kamay niya habang may bakal sa loob.

    oo nga e... un isa pang tumulong sakanyang estudyante sinabihan din sya na nakatigil nga un sasakyan ko bakit pa siya humahataw, pero un mga tambay naman dun sa labas ng school nakiki usyoso at humihirit pa, akala pa ata ako un bumangga sa nagmomotor.....ang plano lang naman kasi talaga ihahatid ko sya sa hospital dahil nga di naman siya makakapunta dun mag isa at bali nga un kamay nya(dapat ata pinaputol na lang un kamay nya para quits lang kami ).... sinabihan na lang ako ng mom ko na kalimutan ko na lang daw..wag ko na lang daw isipin un pera at mabuti hinidi ako un nadisgrasya...

    Sus!!!...Kung ako hahanapan ko ng tama or kahit dumi yung pintura ng kotse (to the point na gawa gawa ko na lang yung tama)...At Hindi ko papupuntahin siya ng hospital hangang di nya ako binabayaran ng pang hilamos nung pintura...hehehe...kung wala siyang pambayad ay magtiis siya hangang magkaroon ng police report..Hindi naman ako ang unang nangulang eh...hehehe...

If I was in high speeds, I could've ran over the guy as well (which may lead to my demize) and put me to jail. My daughter asked me what happened (which I did not explain further). My foot froze and hands were cold as ice. This is the most drastic, morbid and shocking accident I ever saw and I hope I would never see it again.

    This serves as a warning to motorcycle folks who tend to try being daredevils in the streets. Speed is fun but then use it responsibly. Sorry I don't have pics and I would never intend to take one because it was really nerve racking.
    Something similar happened to a good friend years ago. He was speeding in a bike during a heavy rain. He hit a deep puddle, slipped, and skidded on the asphalt right into an 18-wheeler on the opposite lane. DOA. No chance whatsoever. It was also a closed coffin in his funeral.

    I was just getting comfortable with a crotch rocket at that time. His death was traumatic enough to make me quit and stick with cars.

    buti na lang sir hindi talaga nakita ng daughter mo yung accident... that would be a traumatic experience, lalo na bata pa.

    I friend of mine driving his van also suffered the aggravation of a motorcyclist cutting him in front as he made a left turn at low speed, then demanded he pay for PHp 150k in hospital bills! The police fortunately had no other conclusion than to say that the cyclist was at fault. The point is the piling kup of motorcyle related accidents should prompt motorvehicle and traffic officials to explore ways to screen motorcyle drivers for fitness. Add to this the use of motorcyles for crime (miurder, robbery etc). Each time I see a motorcyle now, I either feel afraid they will cause an accident as too often they squeeze in between cars not only on the sides but even cutting you in front I have yet to see a policeman apprehend a motorcyle driver for recklessness.

    Bubuhayin ko uli ang thread na ito kasi my blog is related with a motorcycle accident along Quezon Avenue a while ago . . .


    Kaya pala grabe ang trapik kanina sa Quezon Ave, at around 3-4pm, kasi may MC rider na naipit sa ilalim ng tanker na nasa larawan. Allegedly, the MC tried to beat the tanker before the U-turn slot by passing thru the left side. Fortunately, when we passed by the scene, the rider is still moving from waist up. I hope and pray that he'll be OK.

    Mapa-biker man o cager , lagi po tayong mag-ingat sa pagmamaneho. Ang maling desisyon sa loob ng ilang segundo ay maaring pagsisihan habangbuhay.

    Ok, I share my tragic experience with these road idiots

    I was bound for manila cruising along national road on a normal speed, when I was approaching a curve suddenly a bike on the opposite direction running too fast miscalculated the curve approaching very quick toward my direction (counter flow) so I swerved on the right shoulder to avoid them but still hit me head on. I was shocked, they were 3 of them on an underboned bike(xrm), a drunken hell driver, a kid, and an 8 month pregnant woman all of them were not wearing any crash helmet, the driver has no driving license and the bike was not registered. Unfortunately the pregnant woman died (sana yung driver nalang namatay), because of course she was 8 month pregnant she shouldn't ride a bike in that condition, but the driver got minor injuries, the kid just suffered few bruises.

    With all of their violations I was still charged for reckless imprudence resulting to homicide, physical injuiry and damage to property by the prosecutor. To avoid these charges and inconvenience in attending hearings coz the accident happened too far from home I ended up paying them 200k, 100k for the driver and 100k to the family of the woman because they claimed that they were not married, f*!$% puro bwitre pala mga yun sigh... kung malasin ka nga naman.

    I was just a simple motorist who just passed by in a place in a very wrong time...

    Anyone of us may charge the same way like mine even how careful you are in the road. There must be something wrong with our law.

    I hope I don't offend you by sharing my opinion. If it happened the way you say it is, then pa-demanda ka na lang. Konting oras lang ung haharap ka sa korte. If the bike's driver is drunk and has no license, wala ka pananagutan. Ma-d-drop ung charges sayo (criminal) ung sa civil charges sasagutin ng TPL. Wala kang gagastusin. In fact, masisingil mo pa sila for the damage sa car mo.
