Ako nung nakabangga ako in an incident like this one, I offered to fix his car, pero gusto nya sa casa, so sabi ko kasuhan mo nalang ako....hanggang ngayon wala pa din kaso, 4 years ago na yun

its the reality of life and driving... siyempre kung sino ang naka banga siya dapat gumastos at magpagawa. siya ang dapat ma-hastle at find ways para maiayos ang damage.... if its your fault then there would really be no excuse, kung ipagawa niya sa preferred niyang repair shop and it cost higher than your's, right niya yun... aggravated party siya.
That is the reason why dapat alert, defensive and responsable ang driver... Hindi pwede isisi sa daan ang nangyari.... so talagang lalabas eh driver error and damages arising from that error should be negotiated...
Now im sure mas careful na sa susunod especially when its raining..
however there's a limitation doon sa right nung nabanga, it should be reasonable enough in price and quality, meaning it will be restored to the original form/shape/color, while still getting a good price...
if matino kausap ang isang tao, im sure a compromise could be rich kung saan parehong happy both parties...

Don't forget to make a quit claim agreement.
Nangyari na sa kin yan dati. Sudden stop sa skyway kaya tinamaan ko sya sa likod. He made me pay for the repairs. Nung bayaran na pinapirmahan ko sya ng quit claim agreement.
A few months later may sumulat sa kin na insurance company. Sinisingil ako ng repair nya ulit! I just emailed them a copy of the quit claim agreement. I never heard from them again.
Ang nangyari daw dun sabi ng bros natin na tsikoteers ay siningil na ko ng mokong tapos pinasok naman nya sa insurance nya yung repair. So he thought he could get away with making the insurance pay for the repair tapos may extra cash pa sya from me.

Hmn... I always thought that the first party is you, the insured; second party is the driver of the other vehicle, and third party is anyone else involved in the accident (kung may tinamaan kang ibang tao pag-bounce mo sa sasakyan nya).
