LTO Double License

Hi, Nadetect po ni LTO na meron pong dalawang driver's license yun pinsan ko nun nag renew sya ng kanyang driver's license. Sino po sa inyo na meron ganitong similar case? At Paano po ninyo naayos? He was told na pumunta sa may LTO east avenue main office para sagutin yun show cause order na letter from LTO pero upon advice from a lawyer, sabi ng lawyer, possible daw na maincriminate nya sarili nya when he will submit an affidavit of explanation. Possible daw sampahan pa sya ng criminal case ni LTO aside from the admin penalties. Upon research, meron daw ito 20,000 na fine at may 2 years suspension pa sa license. Any advice will be greatly appreciated. Sino po sa inyo dito may contacts sa LTO east avenue na makakahelp po sa ganitong problem?

Ang tanong is nag double license ba ang pinsan mo?

Panu nangyari? Say kung taga manila siya at yung 'double license' e sa mindanao yung application mabilis lang naman contest yun. Baka similar name and malas na same birthday but not year, pero iba naman address. Makakapresent ka ng record sa billing mo to prove where you live.

Meron ba instance na meron siya license, nawala at never nagfile ng affidavit of loss sa bagong apply na license?

Kung meron naman siya affidavit of loss na nafile dati, e di simple lang to prove na maayos naman papeles niya on that front.

Ang tanong na lang is yung pagkawala ba is because license confiscation ng lgu na iniwasan before kaya nagkunwari affidavit of loss. Kaso since nagcomputerize na ay dahan dahan na nag sync data ng lto with lgu at lumabas na hindi talga nawala/nakaw yung license but rather confiscated due to violation.

Traceback muna ng facts ng side ng pinsan mo at hindi agad maghanap ng backer sa lto.

Another reason din is because of Biometric Data and Reading Improvement. So mas mahirap lang claim na hindi siya yng sa other license holder kasi same lumalabas sa scanning yung biometric data na nababasa.

Nangyari yan sa kaibigan ko. Yung sa kanya nga magkaiba mga detalye ng apelyido, birthday pero na trace na fingerprint.

Nag submit sya ng explanation tapos na suspend ng 1 year lisensya nyan, tapos nagbayad ng 12k.

Siya mismo makakasagot sa problema niya, did he apply twice ba? If he did bakit?

If not so definitely hindi siya yung ka duplicate.

May biometrics na nga ngayon kaya madali na mahuli yan.

Nag-apply sya twice. Kasi nun bata ata sya may ginagamit syang birth certificate, tapos nun mga 18 years old na ata sya may file yun papa nya which is a foreigner kaya nagkaroon sya ng bagong citizenship. May konting pagkakaiba sa details ng dalawa like may isa may foreign name, pero same birthday naman. The reason why sya kumuha ng pangalawa is para sa valid ID lng kasi since he is using that identity na since bata pa sya. Actually handa na sya pumunta sana sa LTO para ayusin, concern lng nya is yun sa possible criminal liability na pwedeng icharge sa kanya after consulting with some lawyers. Kaya nakikibalita muna dito para iwas sakit din ng ulo in the future. Thank you po mga boss.

Kailan po nangyari ito sa friend ninyo? recently lng po ba? At saan nya po inayos yun problem? Out of the two license, if one is suspended for 1 year, ano po nangyari dun sa isa? narevoke po ba? para maiiwan isa na lng po.

he has to face the music and explain how it came to be.
let us hope LTO is lenient.

one of the licenses is invalidated and retired.
kung mamalasin, the heavy fine is demanded, and the person is suspended from driving for a year.

Actually plan naman po talaga nya punta LTO, hindi din sya takot sa fine at suspension (1 year or 2 years) since may pagkakamali naman talaga on his part. Ang takot lng nya baka hindi kaya kasuhan pa sya ng falsification of public documents which is a criminal charges na meron pagkakakulong. Yan po ang worry nya. Yan din po kasi ang sabi ng lawyer sa kanya na dapat daw mag ingat sa pag explain baka maincriminate sarili.

there was nothing substantial to be gained from the act.

Yes, una ganyan din ang isip ng pinsan ko. But after consulting with 2 lawyers, naging praning na sya. Pwede daw po kasi iendorse sa nbi yun for further investigation. Ask ko lng po if lawyer po yun background ninyo? Thank you po.
