    Customs clears Torres, says no ‘influence-peddling’

    All of a sudden there was no “influence-peddling” done by former Land Transportation Office chief Virginia Torres in an attempt to negotiate the release of a large sugar shipment worth around P100 million at the Bureau of Customs (BoC) last month. Customs Deputy Commissioner for intelligence Jessie Dellosa has clarified that no such incident occurred.

    “We just want to clarify the issue regarding the reported name-dropping of the President’s name by Virgie Torres for the release of the smuggled sugar. The name of the President was never mentioned in their conversation (Torres and Special Assistant Gen. Willie Tolentino) with regard to the request of Virgie Torres for the release of the smuggled sugar,” Dellosa said.
    He added there is a pending investigation over the issue.

    “We are still conducting an investigation regarding sugar smuggling and we have a problem now because it is being overtaken by events. Everything should be treated as confidential,” he stressed.

    Dellosa also cleared that Torres did not mention that the funds will be used by the Liberal Party for the 2016 presidential elections.

    “Neither was there any suggestion from Mrs. Torres during their conversation with the proceeds from the sale of the seized sugar would be used in the coming 2016 elections. The name of the President was mentioned but this was not related in any way to the smuggled sugar shipment. I hope this will clarify the issue,” he said in a text message.

    Dellosa’s statement came after President Aquino practically came to his close friend’s defense, with the Chief Executive saying it was illogical for Torres to be part of smuggling since she is now a sugar planter.

    “Does it make sense for her to facilitate sugar smugglers that will depress the prices of the produce she is investing in?” he said. “Off-hand, I don’t find it logical,” he added.

    Aquino also said he saw no need to personally order an investigation since “I read about the issue in the papers … that an investigation is ongoing. Now, if I still have to issue an order, I think that means someone is not doing their job.”

    According to him, he has not yet talked to Torres but she texted one of his assistants.

    Aquino said Torres is contemplating filing charges over her “besmirched” reputation.

    Torres, a known shooting buddy of President Aquino, left the LTO in 2013 after being caught on a YouTube video playing in a casino.

    According to report, the shipments that Torres had “tried” to recover had been misdeclared as general merchandise. The goods also were not supported by import permits from the Sugar Regulatory Administration, an attached agency of the Department of Agriculture.

    The shipments, which were shipped in apparently through dummy companies, were part of the more than 120 shipping containers of sugar that were the subject of at least 24 alert orders issued by the Intelligence Group in the past five months.

    Torres had disputed the intelligence officer’s claim that she had suggested that the proceeds from the sugar sale would be used in the 2016 elections.

    This is one reason why Roxas will be an inutile pres if he ever win, he won't go after the shenanigans of the Abnoy admin.
    How do you beat with the president in defense to Torres. Kung hindi ka dangan tanga Mr Abnoy, kung saan malaki ang kita dun nakakapit ang mga alaga mo.

    The fact that she visited customz and inquired about the seized vans is enough to influence custom personnel to loosen their grip on the shipment.

    Torres, however, advised this reporter not to bother contacting Sy to get his side of the story.

    In a text message, she said: “Wag na, baka magsalita pa yun kung magkano binigay niya… baka mabigla ka (Don’t bother, he might reveal how much he shelled out… you might be shocked),” suggesting that money may have changed hands at the BOC.

    Torres also claimed that grease money was paid by Sy through a “Jenny Munar.”
    This administration is really in defense of a KKK as Dellosa clear's Torres. But the more she talk, the more incriminating her statement is.
    It's like the long delay Dellosa is taking time on the investigation is because money has already change hands and looking for a good cover up as this is already in the news.

    Lawyer: UN rules GMA detention violates international law

    MANILA, Philippines - The United Nations has ruled that former Philippine President Gloria Macapagal-Arroyo’s continuous detention violates international law.

    Amal Clooney, the celebrated barrister who works with the Doughty Chambers in London, filed the Arroyo case with the UN. She emailed the UN decision to Arroyo’s Philippine lawyer, Larry Gadon.

    “Please be informed that Atty. Amal Clooney sent me an email informing me that the case she filed in behalf of Pres. Gloria Macapagal Arroyo has been won,” Gadon said in an email.

    Last Oct. 2, the UN Working Group issued an opinion which endorsed all of the arguments in the complaint filed by Clooney and “concluded that President Arroyo’s continuous detention violates international law,” Arroyo’s lawyer said.

    In her email to Gadon yesterday, Clooney further stated that the UN panel ruled that Arroyo’s detention “is arbitrary under each and all of the three categories of arbitrariness recognized by the UN Working Group.”

    Breaking it down, the UN panel said “Mrs. Arroyo was denied bail on grounds that are not compatible with international law; she did not benefit from the presumption in favor of bail; she was denied bail exclusively on the basis of the alleged strength of evidence against her; measures alternative to pre-trial detention were not considered and there were undue delays in considering her bail position in the proceedings against her as a whole.”


    The panel recommended the “reconsideration of Mrs. Arroyo’s application for bail in accordance with the relevant international human rights standards.”

    Formerly Amal Alamuddin until she married actor George Clooney, the London-based lawyer specializes in international law, human rights, extradition and criminal law.

    She has represented clients before the International Criminal Court, the International Court of Justice and the European Court of Human Rights.

    Amal flew to Manila to interview Arroyo personally before she decided to take up the Pampanga congresswoman’s case.

    As she said in an interview, “former presidents” also have human rights. Arroyo was president from 2001-2010 before being elected to Congress.

    Arroyo, 68, was arrested in November 2011 following the filing of criminal charges against her for electoral fraud. She was released on bail in July 2012, but was rearrested while in the Veterans Memorial Medical Center on charges of misusing state lottery funds in October of that year.

    Summary of claim
    Arroyo has spent over three years in detention as a result of unproved and politically motivated criminal charges and without any conviction having been entered against her, according to the summary of the former president’s claim to the UN.

    During this period, the Philippine government has failed to protect, respect and fulfill her rights under international human rights law, including the International Convention on Civil and Political Rights, the brief said.

    Arroyo’s legal counsels have stressed that Philippine law precludes the courts from considering a range of factors that must, under international human rights law, be taken into account in deciding whether pre-trial detention is necessary. In denying bail to Arroyo on this automatic basis, the Philippine court also failed to give any consideration to the possibility of applying less intrusive alternatives to pre-trial detention, even though this is required under international human rights law.

    Her lawyers said the Philippine court failed to rule on Arroyo’s bail for over a year, even though international human rights law requires courts to do so within hours or days of arrest.

    Throughout her detention, Arroyo has also been barred from accessing any means of communication, including Internet access, a mobile phone or a laptop computer, which “preclude her from performing her role as a democratically elected representative” of a district of Pampanga.

    “It is hoped that the UN can intervene on an urgent basis, given the long period she has already spent in detention and in light of her deteriorating health and need for specialist medical treatment abroad,” the summary of claim concluded.

    Obviously Abnoy won't even give a minute for it but it surely will be one of those cases will hound him after he step's down next year. As the saying goes, what goes around, comes around. If ever Mar wins the presidency, Abnoy's cases will be one of his head aches.

    Aquino ally in Cagayan de Oro City sacked | Inquirer News


    The office of the Ombudsman has let the ax fall on yet another key political ally of President Aquino.

    In separate decisions that may alter the political landscape in Mindanao in the 2016 general elections, the Ombudsman ordered the dismissal from service of Cagayan de Oro City Mayor Oscar Moreno for allegedly approving a P2.6-million tax break of a private firm without the approval of the city council.

    Ombudsman Conchita Carpio Morales also approved the dismissal of two other mayors—Vicente Fernandez of Matanao, Davao del Sur, and Mamintal Adiong of Ditsa-an Ramain, Lanao del Sur, as well as 27 other local officials in connection with administrative cases brought against them.

    Moreno, who is running for reelection under the ruling Liberal Party (LP), and the other officials were also perpetually barred from holding public office. Adiong is also a member of the LP.
