I received this one earlier today. Dated March 2 pa, pinapasubmit ako ng counter-affidavit (kasi may nabangga akong tricycle na may passenger last 2007)

Now, question is ano to? SOP ba to ng court? According to the complainant (ung passenger which happens to be a law student, not sure kung nakapag-take na ng board) eh inatras na daw nya ung kaso since sinagot ko naman lahat ng dapat sagutin and I was there all the time.

Eh since March 2 pa pinadala and within 10 days lang, di na ko makakasubmit ng counter-affidavit since kanina lang dumating. Tapos ang pre-trial sa 25 na. Nasa letter na if di ako nakapunta the court will issue a warrant daw.

*counter affidavit the period runs from the time of receipt, under the first day excluded, last day included rule, you have until April 2 to submit your counter affidavit. if you think kaya mo i dismiss ang kaso with your counter affid, do so. if hindi, you may or you may not. you may not file kung ayaw mo gumastos.

Sir, baka di pre-trial kundi peliminary investigation...bakit nagyon pa siya nag file?

get a lawyer Sir, asap. or kung mag appear ka dun na walang lawyer, the court will give you one for purposes of arraignment.

basta in the counting of period, count it from the time of receipt of the notice and apply the above rule.

BTW, kelan at saan sinabi ng complainant that he's not suing you anymore? may katibayan po kayo, Sir?

Notice is hereby given that this/these case/s is/are set for arraignment and pre-trial on the 25th day of March 2008 at 8:30 in the morning. Should the accused fail to appear on the said date and hour, this Court will issue a warrant/s for her/his/their arrest.

Last year, napadalan na din ako ng subpoena. May sinabi din ata na if di ako makaattend issue ako ng warrant. Eh late ko din natanggap, buti nalang sabi ng nagcomplain (the passenger) eh inatras nya and no need to show up na daw.

Confusing lang since may ganito na naman, nakakuha naman ako ng NBI clearance last June, accident happened November 2007 so inatras nga talaga ung case. What should I do kaya? Call her first? I lost her number, although alam ko naman kung sino tatawagan to reach her. Eh sa wednesday na ung pre-trial.

Okay na ba ung NBI clearance? Kasi diba hindi ako maissue-han nun kung may kaso. May text sya sakin pero last year pa un. Ilang beses na din ako nagpalit ng phone but same number pa din, nabura ko na.

Sa lawyer walang problema, how ironic nga ung isa naming lawyer eh naging prof nya ata dati.

Nag-file na dati, tapos inatras. Tapos ngayon eto na naman, not sure kung SOP lang to ng RTC or nag-file na naman sya ng case.

Last time, dumaan pa nga ako dun sa isang restaurant ng company nila, sabi sakin nung GM which happens to her close friend eh natutuwa pa nga sakin at ginawa ko lahat ng dapat kong gawin. I don't know where this came from, feeling ko parang na-backstab ako kung kinasuhan nga ako ulit.

GREEN light tapos patawid ung tricycle na naka-stop biglang humarurot sa 4 lane ng southbound ng Araneta eh dun pa mismo sa 4th lane pumunta. Ang luwag luwag ng 1st-3rd lane. Buti nakaiwas ung mga nasa likod ko sakin pati sa kanila, kundi baka nasagasaan pa sila. Sinagot ko lahat ng hospital bills, later recovered from my in-house insurance.

Tas un sabi nya pinatawad na daw nya ako and ung driver ng trike, and sana ganon din daw ako since alam naman nya na ung driver may kasalanan - in the first place ayaw nya talaga dumaan dun and nagpumilit pa ung driver. Underage ang driver, walang franchise ung tricycle.

Pero ano yun, that means na-file ulit ng case? Hindi ba parang ang panget naman nun, nakipag-settle ka na tapos kakasuhan mo ulit. Tas 1 year na tapos magsasampa ulit ng kaso.

Tinext lang nya ko nung sinabi ko sa kanya na nagaapologize ako kasi di ako nakapunta dun sa hearing. Sabi nya okay lang daw since inatras nya na ung kaso. I got my NBI clearance with no hassle, so meaning wala nga. And wala namang pumupuntang pulis dito to arrest me since sabi dun sa warrant failure to appear sa hearing eh issuance of warrant na.

Now same thing is written in the paper diffrent title lang ang gulo

Yea I hope so, sana nga ganon lang at SOP lang ng court itong letter. Kasi chineck ko naman dati, sabi sakin eh natuwa pa daw sakin at inasikaso ko lahat.

Pero pag nagfile ulit ibang usapan na un, how ironic. Kanina lang pinaguusapan si Bayani sa settlement :D

Nope wala eh. Kasi ako lang umasikaso nito. That time kasi graduating pa ko.

Pero ang alam ko may binigay na letter dun sa mga pulis sa EDSA-Kamuning ung TRAFFIC something na office nila dun kaya na-release na ung license ko.

meron din akong nasiko dati sa kilay dahil sa basketball putok yun kilay 7 stiches, dinala ko sa ER pinapirma rin ng doctors ng quit claims..

baka na miss ka lang Lucius nun victim, eh pagkalabas yata ng hospital dinala mo na yata sa biglang liko to "make up" with all the trouble na cost mo sa kanya, pagtapos hinde ka na nagparamdam...

kaya gusto ka lang ulit makita nun...

BTT: ang quitclaim naman or whatever instrument releasing you from any legal responsibility covers only the civil aspect. yung criminal di included yun, because you cannot waive a right belonging to the Republic of the Philippines. once it finds its way to the court, the quitclaim executed in your favor would just release you from the payment of damages arising from reckless imprudence.what the private complainant could do, if he was true in executing the waiver, is not to appear in any stage of the court proceedings. the other party (accused) through counsel may move for the dismissal of the case for failure to prosecute and invoke the speedy justice provision.

dito, once the dismissal gets final, the complainant cannot refile or revive the case as double jeopardy has already attached to the first indictment.
