I don't think the dealers are that stupid to try to pull a fast one on you for the following reasons:
1) Of course you are expected to remember the test unit Conduction sticker number specially if the color is the same as your preference. I suggest you take a picture of the test unit to be on the safe side.
2) You are not that stupid to accept such delivery knowing the test unit tag and all.
3) A test unit has had a considerable milage registered on the ODO that you'd notice right away.
4) You can always remind them to deliver a unit of your choice with the conduction sticker assigned revealed to you before delivery then check the ODO for short term milage usually around 20km from the dealership where you bought the unit. If it is more than that then ask them what is the expected reading for when the unit arrives at your doorstep. You can measure the distance from the dealership to your place during the purchase process to be sure. When my unit was delivered I asked them to use a carrier because the unit was coming from Honda's Sta. Rosa Plant in Laguna so when my car arrived I checked and true enough the milage was 28kms w/c was acceptable to me. Oh and the engine was cold too at the time of the delivery.
5) Lastly, for sure they couldn't afford such embarrassment making you look like you are dumb enough to accept such delivery.
They usually sell their test units at specially discounted prices because of the milage and wear that these units had gone thru. Just my two cents.
This is my 7th car. And i did not expect that a dealer will try a fast one. Trust is inherent because everything is documented. Particularly, one that was ordered and PO'd by one of the biggest companies in the Philippines from a supposedly reputable dealer and brand.
My unit had 63km when it was delivered to me which i found high but the dealer insisted that it was normal and i just shruged off the reason.
The other night when i backed up the photos on my phone, i was surprised to see the photo i took during my test drive. The test unit had the same conduction sticker no as what was delivered to me.
I'm asking the dealer's sales manager to give me a written explanation addressed to the company.
All the more reason you have grounds for claims of replacement. They delivered a test unit that was for sure not brand new by principle unless otherwise they specifically stated that it is and you are the first to test it. You have proof so go on and make your claim. Return the car and ask for a brand new unit. Tell them there seems to be an intent of misrepresentation as you expected to be given not a test unit but an entirely brand new unit. This case definitely merits a DTI report and the dealership should be put to shame if they don't make amends. You are not helpless here and you have every right to get what you paid for, "a brand new car".

Incidentally if this purchase was made thru a bank loan then you should notify your bank to strengthen your claim. Technically the bank still owns the car and the insurance paid for it states that a car has to be valued as such, w/c in your case the premise is brand new. Even a car with low milage lets say 100 kms automatically falls in the category of used vehicle if a number of months have gone by at the time of purchase and release. This means the bank's asset has been depreciated already once released but in your case the unit has depreciated even before you got it as evidenced by your photo on file. This is a clear case of deceit and despite you seeking assurance from the dealer they lied blatantly dispelling the milage as normal and the car still brand new when in fact you have evidence that proves otherwise. Just document your evidence and submit to the bank and they will assist you, or at least I expect them to. Good luck!
There was no notice given to me by the dealer prior to delivery that the unit i received was used for a test drive. Our procurement head has already asked me if i want the unit returned.
Fortunately, the company has a whole group of lawyers to take care of things if we do not get to settle amicably.
The order was made via a PO. As far as i know our company will pay via managers cheque. Technically the car is owned by the company. Hence, the company is the aggrieved oarty.

Guys I'm really super newbie please bear with me. I just wanted to ask when was 2015 CX-5 released? I really wanted to buy one in fact I went to our nearest Mazda car dealer here in Davao and asked for a quotation and so tempted to have a reservation already. Anyway, is it worth to wait for 2016 CX-6 and when do you guys think it gets released?

No problem sir. I got mine last May 2014. It's all the more reason to get one since it's very rare in our area! hehehe! There is already a 2016 model but I'm not sure when it will be released. Probably around 1st/2nd quarter of 2015. If you're in a hurry, the 2015 model goes just fine. However, if you want the latest upgrades out there, you might want to wait for the 2016 model to be released. Those upgrades are really nice especially the rims and the headlights/taillights. I really like the exterior and the leather seats too! Yes I agree the 2015 is fine as well. It's just that I'm not in the urgency to get a new car so I can wait but CX-5 is really an eye-candy. I presume your's is 2015 model correct? Also did you get the 4x2 A/T or AWD Sport? Which do you suggest? Again, sorry for asking too much, I just couldn't find someone who owns a Mazda. I also don't trust SAs that much because they are always biased and the SAs here aren't that knowlegeable. haha.
The updated dashboard of the refreshed CX-5 would be worth the wait. Similar to that of the Mazda 3.
Based on the documents that I signed, mine is a 2014 model. I have the 4x2 2.0 AT Variant sir. If money is not an issue to you, I would suggest getting the 2.5 AWD variant. Those DRLs and 19 inches rims which the 2.0 variant lacks is a thing of beauty! Also, I think the headlights for the AWD variant is better compared to the 2.0 variant. For me, the headlights for the 2.0 variant is a bit weak. I'm even planning on retrofitting the headlights but there's no decent shop in our area that can do the job. Maybe you can recommend me one?![]()
