to the brink na ung toyota noon, e nagclick ang fotuner kasi walang kasabayan....ngayon, naglabasan na, kaya madami na nagpupull-out...

di ba sila naalarma? o sa dearship/agent nalang ung reports ng pull-out?

Try talking to the sales manager. Explain to him or her that you paid the down payment within the promo period. Your receipt is proof. Show her that you were promised free comprehensive insurance. Try to get a copy of the newspaper ad that toyota had free insurance. Insist that the deal was consumated on the day you paid the down payment. The fact that they did not have a car is not your fault. Its their problem. Since the promo was good until Sept 30, does it mean that if you paid on Sept 30 you will not get the free insurance bec I highly doublt that they can give you the car on that day. This is pure BS.

If this is not enough tell them that you will bring it up with DTI and you have friends in the press. Don't worry, you are not lying and will not go to hell. This forum is a form of press.

I'm sure not sure if the fact that you didnt pay them in full last Sept (or within the promo period) might have affected your eligibility or entitlement of the promo (ie. insurance). For example, consumating the sale through full payment within the promo period is very important for eligibility in their raffle draw accdg to the mechanics. I'm not sure about the insurance, though.

His point is that they were promised that are unit will be available in 2-3 days which the said dealer did not deliver. He is not inquiring whether there is still a promo or not. The dealer should honor the agreement since he maid the downpayment / reservation fee during the promo period.

You are defending a lost cause here. You should not include the customer in your problem's with the factory.

Why will he pay for a unit that has not been delivered?

Its really upto the buyer, esp if they really want to avail of the promo. If the buyer paid in full last Sept. then the dealer will have no other recourse (or excuses) to not offer the free insurance esp. since the contract of sale has been perfected (whether it is either an absolute or a conditional kind of contract of sale). And whether or not, the thing (car) has been delivered or not has no bearing of whether it should be eligible for free insurance bec. the contract has been perfected and besides that, the dealer is already in delay.

Regarding the issue of downpayment, the dealer may consider it as an "option" money meaning the money paid as downpayment is considered for the option contract, the application to a sale which has not yet been perfected. In this case, they can say there was no perfection of contract and they are not obliged to offer free insurance.

On the other hand, if the downpayment was considered as "earnest" money then the buyer is eligible for free insurance since such payment is given when there is a sale and the contract is perfected.

On the two scenarios above, it would depend alot on what the agreements bet. the parties are.

sadly the usual excuse is to put blame on the agent. convenient for the company imho.

Pasok dapat sa promo yun, labo naman nung dealer, kaya nga humabol si buyer sa promo period for the free insurance eh, its not his fault kung nagka delay-delay man ang pagbigay ng lecheng sasakyan as long as he had paid the amount within the promo period. downpayment man yan or in full! Sumbong mo kay Tulfo! Yari yan!

Nakowww! Dami palang mga loopholes na pwedeng lusutan nung ahente. They should give you the freebies when you made the DP. Mukhang pinaikot ang buyer. Tsk..tsk....

confront/ talk directly to the general manager along with the sales manager and the agent who sold you the vehicle... don't forget to bring along a lawyer or a representative from the DTI so that they know that you really means business...

aside from the delays and the time and efforts you make to purchase that car... tska malaking bagay din iyun cost ng insurance...

    1. unit
    2. insurance
    3. financing
    4. plate ending or special plate
    5. pati chattel mortgage and vehicle registration may tubo rin sila

With the recent events in Thailand, stop production ang planta ng Toyota.

dapat gawan paraan ng agent niyan, he should shoulder the insurance since he promised the buyer. withdraw your money plus interest, damages na hindi ka nakatulog kase 10 days na wala pa kotse mo.
