question pala to the lawyers out there: can an alleged crime of assualt really be settled amicably? di ba yung complainant sa kasong ganito ay "people of the philippines vs."? if so, how can the parties settle? or is the case simply dropped once the victim ceases to give testimony? curious lang po ako, thanks!

In a nutshell, kahit criminal case (where the plaintiff is the People of the Philippines), pwedeng magkaroon ng amicable (or out-of-court/extra-judicial) settlement, if the complainant decides not to pursue the case by executing an affidavit of desistance. Of course, the state can opt to continue, pero without the testimony of the complainant, no prosecutor in his right mind would dare to proceed, for sure kasi, mahina ang kaso, and ang tendency, madi-dismiss lang ito.
When they settle, they have to sign a compromise agreement, which has to be approved by the judge.
The case cannot be dropped if the victim refuses to testify, the court hearings would have to go on, and the lawyer of the accused has to make a motion in court to dismiss the case for lack of interest on the part of the complainant. Then the judge would have to rule on that motion. Pero matagal pa na proseso ito, it takes weeks to set a preliminary investigation, tapos may pre-trial conference pa or mare-refer pa kayo sa Mediation, then setting of the hearing schedule (kung walang nangyari sa mediation). Sa QC, it takes 2-6 months between settings (sa sobrang dami ng kaso doon), kaya sometimes it's really not worth filing a case here
