Previous posts only shows, nationalism or you may call it patriotic.

No Indian, Chinese, Black, White or whatever has been mentioned.

Clearly, we are one just trying to resolve the issue of who is wrong and what really happened so as to guide us when we encounter such incidents.

natignan nyo na po ba yung photo ng enforcer na binanggit ko? wala kasi sa philstar.online kaya di ko mapost. i find it hard to believe a single person could have inflicted so much damage in so little time, so i still find it hard to buy the self-defense theory. and kahit ano bang yabang niya, kelangan bang gulpihin ng ganon? (ok, ok, mey mga maaangas nga na ang sarap kutusin minsan! hehe!)

and while tabloids tend to jazz up their news stories, broadsheets generally tell it as it is, albeit with a bit of dramatic flair involved, which is why i take the phil. star report at face value. it's actually the broadcast journalists and camera men i've seen displaying really outrageous behavior. ("sige maam, samapalin mo na yung nagnghipo sa inyo!" sabay record sa camera)

Am not a lawyer, but I've attended numerous court hearings (kasi I've been empowered by my company to represent them in our civil/criminal cases as the complainant)...

In a nutshell, kahit criminal case (where the plaintiff is the People of the Philippines), pwedeng magkaroon ng amicable (or out-of-court/extra-judicial) settlement, if the complainant decides not to pursue the case by executing an affidavit of desistance. Of course, the state can opt to continue, pero without the testimony of the complainant, no prosecutor in his right mind would dare to proceed, for sure kasi, mahina ang kaso, and ang tendency, madi-dismiss lang ito.

When they settle, they have to sign a compromise agreement, which has to be approved by the judge.

The case cannot be dropped if the victim refuses to testify, the court hearings would have to go on, and the lawyer of the accused has to make a motion in court to dismiss the case for lack of interest on the part of the complainant. Then the judge would have to rule on that motion. Pero matagal pa na proseso ito, it takes weeks to set a preliminary investigation, tapos may pre-trial conference pa or mare-refer pa kayo sa Mediation, then setting of the hearing schedule (kung walang nangyari sa mediation). Sa QC, it takes 2-6 months between settings (sa sobrang dami ng kaso doon), kaya sometimes it's really not worth filing a case here
