    WTF is wrong with these guys. Mga professionals pa naman. Baka fan ng wild wild west type of palabas or movies.

    Mababaw na dahilan para pumatay ng tao. SMH

    Ok lang yan para mabawasan ang mga tanga. Sana mamatay na rin yung isang tanga sa tetano. Professionals??? Baka sa kaladkaring school galing.

    The Engineer (Ardy Cristobal) graduated from Mapua. Has acted as Principal Engineer for some big ticket projects for major companies (HP, AshTech, etc.) in Singapore. The Lawyer, Nelson Belen has been a Customs Port Collector (Manila, Tacloban) for some time now. Nasabit na sa mga revamp na ginawa ni Pnoy at na-floating assigment. The lawyer is also known to own some nightspots in the Caloocan area.

    Paging Juan Martinez. What's your take on this? They both talked about a duel. Went back to the same spot. Both were shot. Can the survivor claim self defense? He did surrender afterall.

    keeping the gun at home is one way to dissuade road rage from escalating into something else. but in this instance, if the story is true, they went out of their ways to go home and get their weapons...?? clearly the intent to kill was there. blood lust! murder and attempted murder!
    what were they thinking??!!! were they drunk? or was it a bad day at the office?

    sometimes, the ego and pride put you in delicate situation, maybe yes maybe the intent is to make "duro" or see if the other one won't show up and naturally he's the more "astig" but nagkasubuan na so ayun....sayang mga pinag-aralan nila

    both of them went home to get their guns.

    both had premeditated intention to kill.

    one was wounded. attempted murder.

    one died. murder.

    it does not matter who shot first. both were equally guilty.

    2 a$$holes off the streets.

    unless of course the fiscal and the judge err in favor of money then it's only 1 a$$hole off the streets.

    Yep. There is no case for self-defense as the element of unlawful aggression was not present. The survivor may be liable for the crime of Dueling under Art. 260 of the Revised Penal Code.

    Dueling is actually a crime. If it results in one getting killed, the other participant may be put in prison from a minimum of 12 years to a maximum of 20 years. Bilibid yan. There's no defense.

    The engineer would probably be better off not admitting there was a duel so he could claim self defense.

    Yes, the better storyteller will normally emerge as the winner. But what is crucial here, if the story is to be believed, is that they first went home, presumably to get their firearms, to shoot at each other afterwards.

    1) a newspaper report is hearsay. inadmissible in evidence unless the rule on "independently relevant statement" applies.

    2) IF TRUE, violation of art. 260 rpc. no separate crime of murder. reason: double jeopardy.

    3) another violation if true: comelec gun ban

    4) IN COURT, it is not what you know, but what you can prove.

    5) lesson: if you're a hothead, carry a gun and die early.

    6) i agree with the opinion of altis and machine pistol, in the same way that if i had my wisdom tooth extracted i would see a dentist.

    7) i would have agreed with the opinion of attorney but he was banned. i think his punishment was not commensurate to his offense. that's why i asked "what is the standard?" and that's why i lost a little enthusiasm to post.
