"If you are held or detained based on a suspicion that you committed a crime, the law prescribes a period of time for detention. The duration depends on the nature of the offense committed. Thus, the following time limits based on the nature of the offense:
* 12 hours for crimes such as slight physical injuries and reckless imprudence resulting in damage to property;
* 18 hours for crimes such as serious physical injuries, less serious physical injuries, reckless imprudence resulting in damage to property;

No wonder some drivers involved in an acciden flee the scene.
If you flee the accident scene, the police will need to identify you as the driver and can only arrest/detain you if they have a warrant of arrest.

May batas na dyan.
Under the New Civil Code Art. 2185, unless there is proof to the contrary, it is presumed that a person driving a motor vehicle has been negligent if at the time of the mishap, he was violating any traffic regulation.
So ang burden to prove na mali ang nabangga ng mga nagcocounterflow is sa mga nag-counterflow. Mali yang automatically attributable sa driver or rider. Walang ganyang batas but kapalpakan lang sa diskarte ng police or traffic investigators. If mag-imbestiga sila ng mabuti, maaring hassle na magpaliwanag habang nasa custody si driver or rider pero hindi na siya kakasuhan at papaalisin na din kapag napatunayang walang kasalanan.
Kaya hindi mapasa yang batas na yan eh dahil sa need naman talaga pa rin ng formal invetigation at siyempre it will take hours.Fasten your seatbelt! Or else...Driven To Thrill!

in this case,
if both parties were driving a motor vehicle,
and the video did clearly show how and why the occurence occured,
and who was the mistaken party...
at the very least,
while the bill is not yet passed into law,
pinayagan sanang maka-uwi yung pobre.
ang nangyayari kasi,

Kaiangan talaga ng new law specific sa mga kamote.
Yung provision sa New Civil code Art 2185 and the likes ay hindi para sa mga pulis or traffic investigators to interpret and draw conclusion , para yan sa mga fiscal and judges.
Kaya kung ganyan may aksidente at preliminary imvestigation points to the likely culprit (kung buhay pa) dapat yun ang idetain at pakawalan nayung least probable guilty.
Ang nagyayari ngayon, gusto ng mga pulis na hindi na umabot sa fiscal yung kaso, kaya pati areglohan pinakikiilaman nila kahit walang klaro resulta yung imbestigasyon nila kung sino talaga ang may mali.
Anong klaseng sistema yan na klaro ng sino ang may mali yung naagrabyado pa ang nakulong ng sobra sobra sa prescribed ng batas.
Kaiangan pang hintayin yung abiso ng pamilya ng kamote kung papa areglo sila.
Kaya kailangan ng batas para may guide o protocol na dapat sundin ang mga pulis sama na mga fiscal sa mga aksidente.
Sa kaso nung sa skyway , dapat pati yang management ng kyway kasuhan, nagbayad ka ng toll tapos compromise safety mo dahil sa kapalpakan nila.

Or meron bang parang detaining room within the police station?
Itong tanong ko ay tungkol lang sa traffic issues.

Mukhang magandang case study yan for thesis sa mga IT.
New application or process improvement ng police report / investigation. Kung meron naman pala batas, sa implementation pala ang problem.
Wala bang police na representative dito sa Tsikot? Hehehe Di pa kasi ako nakapasok sa any police station di ko alam kung meron na ba sila computer. Ang nasa imagination ko pa din na typewriter lang gamit nila. [emoji23]
OT: Wala pa nga show or pelikula sa Pilipinas na pinapakita yung scene kung paano mag-file/report sa police station.. Kaya typewriter pa din nasa imagination ko sa mga old movies kapanahunan nila FPJ, Eddie Garcia atbp.

April 17th, 2024 10:48 AM #4628most nakikita ko sa news behind bars eh kasama ng ibang kriminal na naka "detain". kaya sobrang traumatic talaga. imagine also seeing the angry relatives outside na nagddrama at nagdedemanda ng hustisya. tapos makikipag "areglo" sayo para di sila magkaso. eh alam mo naman ano ibig sabihin ng "areglo" sa atin, siguradong may bayaran.

Dyan maganda kumunsolta or kumuha na ng lawyer. Mas mabilis kasi at hindi na tatagal detention ng nabangga.
Again nangyari na sa akin yan at gumawa lang ako police report at hindi ako nadetain or kinasuhan. Lalo na may video evidence. Baka nagtipid lang yang si manong driver kaya hindi pa kumuha ng abogado.
Pero I agree na maganda meron na batas na mas malinaw protocol na dapat ayusin muna investigation bago sabihin kung kakasuhan or hindi at kung may ganyan nga na convincing evidence of negligence eh yung bumangga dapat magpatunay na walang kasalanan ang nabangga.
In the end, kahit may bago pang batas, kung TAMAD and imbestigador, areglo lang ang iisipin niya para walang trabaho at paperworks sa kanila.Fasten your seatbelt! Or else...Driven To Thrill!
