    Hi,

    I bought a car last year. The car was company owned then was sold to a subsidiary company then the employee bought it before I bought it from a buy and seller.

    Here are the documents I have

    Orig OR & CR of the 1st company owner
    Certified true copy of the DOS of the 1st company to the subsidiary company
    Xerox of the secretary's certificate from the 1st company
    Xerox of the DOS of the subsidiary company to the employee
    Xerox of the scretary's certificate from the subsidiary company
    Xerox of an open DOS signed by the employee

    It was a dumb mistake for me to buy the car since I was only furnished the original OR & CR when I made the payment. The buy and seller promised to send the DOS to me after. Apparently, medyo mahaba na pala ang history ng kotse.

    Will the TMG and LTO honor the xerox documents?

    I just handled my Advie's transfer of ownership and registration 2 weeks ago. Mabilis lang ang TMG/HPG clearance, less than 1 hour kung maaga ka at may padulas na P300 to P600 depende sa branch nila. LTO registration takes only half day, so kaya lahat tapusin in 1 day.

    See below the requirements and steps.

    For HPG/TMG Clearance
    1. Bring original and photocopies of the Certificate of Registration (CR), Official Receipt (OR), and notarized Deed of Sale.
    2. After parking your car at the HPG grounds, open the hood of your car to allow cooling of the engine prior to macro-etching of the engine number.
    3. Submit the photocopies of the 3 documents to HPG personnel who may check the original copies for verification.
    4. Applicant receives the request for clearance form, as basis for Php 300 payment to Landbank.
    5. Pay Php 300 to Landbank, then go back to HPG office to submit the request for clearance and Landbank receipt.
    6. HPG personnel will usually fill up the motor vehicle application form below after getting the information from the submitted documents, then will ask the applicant to sign it.
    7. A HPG crime lab personnel will perform the macro-etching of the engine and chassis numbers and will record the info on the 4 carbonless copies of the macro-etching certificate. Lending them a rag and/or a flashlight will hasten the process. Php 20 as tip is optional.
    8. HPG office will verify if the vehicle is not on their list of wanted or stolen vehicles. Will take them 15 minutes or more depending on the number of applicants.
    9. If there is no problem with your vehicle, HPG will release your motor vehicle clearance after 3 days (standard processing) or within the day (if you opt to pay bribe).
    10. The clearance is valid only within 7 days, so try to register your vehicle at your mother LTO branch within this period.

    For LTO Registration with Transfer of Ownership
    1. Bring your vehicle's OR, Certificate of Registration (CR), and Early Warning Device (EWD), the latter you should always have on your vehicle anyway. If there's a transfer of ownership, bring the notarized Deed of Sale, HPG's vehicle clearance, and photocopies of the previous owner's 2 identification cards.
    2. Bring also a certificate of coverage of Third Party Liability (TPL) insurance prior to going to LTO. I suggest that you get if from legitimate insurance companies' offices, as its cheaper by half compared with those offered by insurance agents in LTO compounds, plus you avoid the risk of getting fake insurance if ever you will need to make a claim in the future.
    3. Upon your arrival at LTO compound, have your vehicle undergo a smoke emission test which regularly cost about Php 400 to get the certificate. If your ride runs on diesel fuel, you may want to clean the muffler/exhaust lines prior, to ensure that you pass the emission test.
    4. While waiting for your emission test, you can allow one LTO volunteer to stencil your vehicle's engine and chassis numbers on the Motor Vehicle Inspection Report (MVIR). Usually, he will help you in filling up the MVIR. I normally give an optional tip of Php 20 to the stencil guy.
    5. Submit your documents to the concerned LTO windows for validation and assessment of fees.
    6. Pay the fees only to the cashier once your name is called. It will be faster if you prepare exact amount by bringing some loose change.
    7. Wait for your new OR. If its transfer of ownership, you will also be given a new CR. Have them photocopied if requested by an LTO officer.
    8. Once you receive the new stickers, you're done.

    Paano naman po kung Transfer of Ownership lang ang ggawin ko kasi registered na siya nung nabili ko?

    Ano po kaya kailangang kong docs and how much abutin?

    just the same. it's like you have the vehicle registered again, but this time, under your name. parang redundant na. actually, yung transfer of ownership kasi ang mas maraming docs, you have PNP-TMG clearance, endorsement of insurance company from previous policy owner to new policy owner na wala sa plain registration renewal of vehicle. it would be better to wait for the next registration period of the vehicle IMHO.

    Ganun po ba? Kasi nagbayad na ng insurance ung unang nagprehistro di ba.. sayang naman pero nung tinawag ko eh mattrace daw kung bayad n..

    Tsaka kelangan ko na matransfer para sa insurance eh..
    So you mean irregister ulit un after matransfer?

    walang problema kung ipa-endorse mo lang sa insurance company na ikaw na ang new policy holder. iffax mo lang sa kanila ang DOS mo. kaso yun nga lang, hindi pa notarized ang DOS. pero kung ipa-notarize mo, makakaproceed ka na sa endorsement ng insurance from previous owner to your name. kaso, ang kapalit niyan is penalty sa LTO dahil magpapatransfer of ownership ka sa kanila after ilang days na after ng notarization. pero kung wala kang tiwala sa previous owner and/or for peace of mind, then proceed with the whole process for transfer of ownership after notarization para wala na ring penalty. less than 5K lahat-lahat lang naman magagastos mo.

    btw, punta ka sa LTO branch na naka-indicate sa CR tapos dun ka magpa-transfer of ownership.

    Sayang gastos ah.. sabay ko na lang kaya sa rehistro next year..
    Basta sure na walang ako magging problema pag nagclaim ako sa compre insurance hehe..

    wanna share my case....
    I bought this 1991 corolla sa second owner. the car was 1st registered sa Cebu. Plaka niya is G. xerox na lang po yung OR and CR kasi nawala na daw ng 1st owner yung CR dati pa. pero may affidavit naman po yung 1st owner na beyond recovery na yung CR, kung anu-anong clearance,deed of sale at kung anu-ano pa! may document po akong nakita na binigay saken ng 2nd owner na may confirmation request sila from LTO Cebu para mai-transfer na yung ownership sa pangalan ng 2nd owner and matransfer na din ata yung file ng car from Cebu to Pasig ( sa Pasig na po pala nirerehistro yung car simula nung mabili ng 2nd owner yung car at zerox lang ng CR meron siya).
    Tinawagan ko po yung 2nd owner to confirm what happened sa request nila, he said na after a year nung nagrequest sila ( i think nung 1999 pa ata yun..hehehe ) na matransfer yung file dito sa Pasig, wala pa din daw yung file,so tinamad na daw siya at di na naasikaso.
    I talked to a "kapit" sa LTO para malaman kung ano puwedeng gawin.
    icconfirm muna daw niya kung nandito na sa LTO Pasig yung file and kung may ID with signature silang kopya dun ng 1st owner. pero the lto guy said na dapat nandito na since sumagot ang LTO cebu sa confirmation request nila na binayaran ng 2ng owner.hehehe.
    Ang problema lang daw kasi sa mga lumang cars like mine, hindi pa computerized noon. type writer pa ginagamit kaya may pagkamatagal ang pagpproseso.
    Nakapangalan padin kasi sa 1st owner yung car.
    Hindi na din mahagilap nung 2nd owner yung 1st owner. pero I have their address in Paranaque. Maybe one of these days, magrroad trip ako para mahagilap siya for the ID and signature. kakailanganin ko daw eh.
    Gusto ko na din kasi magkaroon na ng kopya ng CR eh, tapos mailipat na sa name ko.
    the lto guy na pinakilala saken is asking for like 4.5k para maasikaso niyang lahay,siya na daw maglalakad for me...lipat na din sa pangalan ko...hehehehe... balitaan ko kayo guys kung ano mangyayare... para magkaron din kayo ng idea at para maipakilala ko din tong kapit na to. mabait naman at mukhang di manloloko. malaki ba yung hinihingi guys? di ko lang maalala masyado yung hinihingi eh.. tatawagan ko na mga lang ulit siya.sabi ko kasi magiipon muna ako kasi rehistro nadin ng oto ko eh.. hehehehe.
    baka may mashshare pa kyo na ganitong experience din.

Procedure of Change of Ownership
