    Hi guys just wanted to get ur opinion on a particular issue. We all know the LTO folks tend to do random violatuon inspections on the road for motor vehicles, today while driving I was flagged by an LTO personnel and i was wondering what cud the issue be, my headlights and tail lights were fine, newly registeres, and recently renewed license, and was wearing a seatbelt, so when the guy pulled me over, I usually have this habit of removing my seatbelt everytime I park or double park, so when i pulled over on the side of the road, i removed my seatbelt and lowered the window to ask what i did wrong and the guy told me I wasnt wearing my seatbelt, so my question is, am i in the wrong becos i removed my seatbelt after stopping?

    What happened after?

    Kita naman niya siguro if kaaalis mo lang talaga nung seatbelt mo.

    No violation on that.

    Baka hindi ka naman talaga naka seatbelt? (Pardon playing the devils advocate only)

    Yes based on RA 8750.

    "Private motor vehicle are required to wear or use their seat belt devices while inside a vehicle of running engine on any road or thoroughfare"

    But if he removed his seat belt after he got flagged then it would seem pinara lang siya tsaka hinanapan ng pwedeng ikaso sa kanya.

    Yes i was indeed wearing my seatbelt while I was driving, cos im a bit paranoid when it comes to accidents so i take all precautions since my steering wheel isnt equipped with airbags, they wouldnt even be able to determine that i wasnt wearing one bcos my window tint is ridiculously dark, i even wish my windows werent bcos then it wud have been easier for them to see that i was indeed wearing one wyl driving, but you know if the seatbelt law appliesto a car that is either in motion or at rest then so be it ill take the penalty, but if it isnt, i just find it unfair, when it comes to things like our lisence and plates they give all the excuses and delays in the world, but when it comes to these dishing out of violations and fines their quickness and punctuality is through the roof.

    you can contest the ticket at the lto.

    then learn your lesson. when flagged down keep your seat belt on.

    then that sets it off, your ridiculously dark tint, they couldn't see if a good person or a criminal is inside the vehicle... you should only remove the seat belt when the vehicle is not on the road... your so paranoid with safety but did not think that seat belts are still needed in case you are rear ended...

    so there you go, not wearing of seat belts while operating a vehicle...

    Hmmm Im just thinking what if you still have your seatbelts on, ano kaya dahilan nila for flagging you down?

    Premise is you have a dark tint, hindi ka visible from the outside.

    So they'll gonna flag down all dark tinted cars praying someone inside is not wearing seatbelt?

    Ang turo sa akin noon pag upo mo at bago mo isaksak ang susi uunahin mo muna ang seat belt. Ang pinaka huli mo naman gagawin bago bumaba ng kotse mo ay ang pag tanggal ng seat belt.

    Kung pag hinto mo tinangal mo ang seat belt mo iisipin ko talaga na di ka naka seat belt at palusot lang na kakatanggal mo lang ng seat belt.

    Hindi normal na bigla mo agad tatanggalin ang seat belt mo the moment na huminto ka. Anyway alam naman ng Diyos kung sino ang nagsisinungaling. Si enforcer ba o si driver.

    Like i said i know what i did, so if the law says that seatbelts must be on wther in motion or not, then ill just pay d fine, lesson learned for me

    I learned this from an Australian guest years ago. He would always put the belts on before I start the engine & wouldn't take it off until I shut off the engine. The car doesn't have to be on the road. As long as the engine is turn on, you & your passengers should be belted down. Think SUA.

    Pwede mo naman i-contest sa lto kung alam mo na nasa katwiran ka.San ba ung lugar kung san ka hinuli?Pero kung sa expressway entry/exits,ka nahuli,wag mo na i-contest.

    TS, aba magaling ang ESP nitong TE, mala madam Auring. alam nya ang magiging violation mo nung pulled over ka nya.

    Seriously, If you wish to contest the ticket at the LTO you may do so but IMO just wasting your time. You have to prove a factual evidence to LTO as your defense against the TE such as his claimed. the burden to prove is in your side given in this situation. for instance in other situation, the burden of proof may required of the accuser is to prove the guilt of the accused. but based on my experience ang taga LTO pinoprotekhan din nila kanilang "kabaro". Therefore your contest may be dismissed without having to put on any factual evidence. Goodl luck.

    Wala ng ibang details ts? Hindi ka na ba nakipag reason at ano ang isinagot sayo? It would be helpful and interesting to know. Baka naman you ran a red, made a left ot unknowingly made a small violation and then nakita na nagtanggal ka ng belt?

    Kaya I asked what happened after?

    Probably may iba pang reason kaya TS got flagged.

    Since hindi nga siya visible from the outside, eh nataon nagtanggal siya seatbelt, more of a concrete violation wala ng diskusyon since hindi nga nakasuot.

    Its quite odd what happened, kahit siguro anong bait at inexperienced ng motorist kahit papano makikipag reason ka muna. But then again lets all be careful. Baka bagong MO ito. Do not do anything (stupid) pag pinara ka and be calm and alert.

    Paminsan hindi ako naka seatbelt sa mga mall parking lalo pag steep and mejo maliit na tao kasi ako so kelangan ko mas nakakagalaw sa loob to widen my view. In recent times kinakabit ko na before moving.

    +100. This is what I do

    As long I am inside the vehicle I have my seatbelt on.

    There are a lot of accidents wherein the car getting hit is stationary. May mga kilala ako pag pasok ng parking tanggal kaagad ng seatbelt.

    May violation na nga rin na nangyari (pag tanggal ng seatbelt)

    TS should think of it as learning experience na lang so he knows the protocol now on wearing seatbelts.

    Ironic kasi, sa experience ko na ako ang passenger and the hindi naka seatbelt si driver pag nakakita ng TE/Pulis yun driver nagkukumahog magsuot ng seatbelt.

    In this case, pinara ka na nga for no reason and yet magtatanggal ka ng seatbelt prior lapitan ka ng apprehending officer.

    Pero TS says more of a mannerism na ito, you need to avoid the practice na hehe

    i agree. removing the seatbelts while still in the car, is a bad move... what with the apprehending officer walking towards you...
    were i the one in there, i would have latched on my seatbelt, if it was not latched on before...
    besides, why remove it? we are not allowed to exit the car, anyway.

    ah well... perfect hindsight, we all have...
