I don't have any against the decision of court of appeals. Ang sa akin lang, sure ball naman na mag appeal pa ang city of Taguig eh. Baket etong si Junjun agad agad i-take over ang BGC? Hinde ba dapat hintayin na lang muna ang decision ng supreme court bago gumawa ng hakbang?

According to Mayor Junjun, the CA has lifted the restraining order imposed Regional Trial Court "with immediate effect". Unless Taguig can get a TRO from a court higher than the CA, they have to abide.

MANILA, Philippines—A day after the Court of Appeals sided with Makati city on a two-decade-old dispute with Taguig city over Fort Bonifacio, the former’s local government is already prepping for a “smooth transition.”

“Expect that maybe in two weeks, you will see the presence of Makati there,” Mayor Jejomar Erwin Binay Jr. said in a press briefing in his office on Tuesday morning.

“We will make our presence felt in the area. We will place our personnel there, then start implementing our laws,” he said, adding that he has been meeting with the Makati assessor, engineer, administrator and some businessmen operating in the two cities.

“There” refers to a territory bordering the two cities, composed of the Embo barangays (villages)—Cembo, South Cembo, West Rembo, East Rembo, Comembo, Pembo and Pitogo, and Inner Fort barangays Post Proper Northside and Southside.

The appellate court, in a 37-page promulgation last July 30, confirmed that the disputed areas were within the territorial jurisdiction of Makati, and ordered Taguig to “immediately cease and desist from exercising jurisdiction within the disputed area and return the same to Makati.”

Under the territorial dispute, which started in 1993, Binay said a preliminary injunction was issued against Makati in 1994 from exercising jurisdiction over the Inner Fort. This injunction was also lifted by the CA decision.

“We couldn’t move there because of the injunction, but now it’s been lifted, we can move forward. We really need to fix that place. They were the ones who were most victimized,” Binay said, adding that the Barangays Northside and Southside residents have been suffering from faulty roads, utilities and land distribution.

Binay said that losing BGC would mean a huge financial blow to Taguig City. “I was thinking it may also affect their status as a city, because they will have reduced revenue and land area—which are some basis to determine cityhood. They might revert back to municipality.”

I am really not happy about BGC being part of Makati again. But in all fairness, the Fort really was part of Makati. My friend lived at the Fort military staff house where BGC is now and his address was Makati. I was surprised that Taguig even fought for the area and moreso when it won. But I like the laidback atmosphere of BGC unlike in Makati. Too many mapsa, too many towing, too many rules and yet traffic is still bad.

Ayala is also privately owned but they implement the number coding scheme. Once the local government agrees to take over the traffic chores, that will be the start. Currently, the owners of BGC provide for their own traffic team consisting of security guards.

yes, but it's logical to have number coding in Ayala because every adjacent areas are implementing the coding scheme, vehicles may get stuck there if they don't implement it. for BGC, there's no coding scheme in taguig.

The ruling of the Court of Appeals (CA) ruling Fort Bonifacio as part of Makati territory is a boon to the premiere city but a bane to business operating in Bonifacio Global City (BGC).

The CA decision will force BGC businessmen to pay the tax that Makati collects.

Businesses in BGC pay property and business taxes 30 to 40 percent lower than the rates charged in Makati.

Property analysts said the lower tax rate in BGC was intended to attract business establishments to the area. The lower rate was effective from 2005, come-on of BGC as a location for businesses since it started development in 2005.

The tax collection from BGC, being a part of Makati, will make the premier cityeven richer. Its income averages P11 billion a year.

Melito Salazar Jr., president of the Management Association of the Philippines, said that with BGC as a part of Makati, would create two business districts in one city. Salazar said that the competitiveness of BGC enhanced with a lower tax rated will be wiped out.

Salazar said the “fight” over jurisdiction between the two local government units, Makati and Taguig, may pose a concern on businesses.

“We would want issues like this to be resolved speedily even if the local governments involved are both business-friendly,” Salazar said hinting at a possible elevation of the dispute to the Supreme Court.

Karlo Pobre, analyst at Colliers, said the two business districts can prosper on their own.

“There is a 30 to 40 percent tax discount in Taguig. And that has been the sole consideration of businesses locating in BGC, Pobre explained. If Makati takes ownership of BGC, (tax) would be a big consideration,” said Pobre.

Nonetheless, as of the second quarter this year, it was the lack of new buildings in Makati that also attracted business to BGC. In fact, Pobre said, some establishments in Makati transferred to BGC for rental reasons.

Pobre BGC still has more vacant office spaces to offer to business. In fact Pobre said 35 percent of total new spaces are in BGC.

A Fort Bonifacio has 230,000 sqm incoming supply for 2013; 150,000 sqm next year and another 150,000 sqm in 2014.

Makati has only about 74,000 sqm in new spaces this year.

Pobre said lease rates for Grade A office space in BGC and Makati are at P756 and P745 per square meter per month, respectively. However, only Makati offers premium spaces with average lease rates of P850 to P1,200 per sqm per month.

These are the likes of RCBC Towers, Tower One, Enterprise Building, and Zuellig Building, among others.

Technically,has an area of 240 hectares and is located within the 400-hectare Fort Bonifacio, which also covers the area across C-5 where some residential developments of DMCI and SM Development are located.

BGC is the property being developed by Fort Bonifacio Development Corp., a joint venture of BCDA with the consortium of Ayala Land Inc. and Evergreen Holdings.

The main roads, I'd guess can be subject to the city ordinanaces since they are public access (im just guessing) as that's the case in Makati CBD.

A few years ago, at the Ayala Center Malls, hinabol na ako ng sekyu nila (using an Ayala Center rent-a-cop Dmax). It was very late at night and I made a turn onto Ayala Center from the second lane of Makati Ave. because a jeep was stopped at the corner. Lo and behold, i was wondering why suddenly there was a pick-up trying to get ahead of me to the point of making "git-git" but could not get ahead because of my more defensive position on the road; i figured it out when the sekyu at the corner was trying to stop me. I saw all streetlights from Ayala Center to Ayala Ave were green so I downshifted and redlined on 2nd and 3rd for my get-away. Taena, ako pa yung aabalahin at hindi yung jeep na illegally parked sa corner. That's the second time that happened to me inside Makati (in both cases i got away from the Ayala Sekyu and the MAPSA).

Exactly. They don't even do anything about the trikes and jeeps parked along Kalayaan Ave that impedes traffic flow, big time! At the CBD, they will tow parked cars but what for? Eh the jolly jeeps still block the road anyway.
