    Fort Boni is part of Makati, not Taguig, CA rules

    MANILA - The Court of Appeals (CA) has ordered Taguig City to stop exercising jurisdiction over the 729-hectare Fort Andres Bonifacio or Fort Boni since this area is part of Makati City.

    In a 37-page ruling penned by Associate Justice Marlene Gonzales-Sison, the appellate court’s sixth division upheld several presidential fiats declaring Fort Boni as part of Makati.

    In a text message, Makati City spokesman Joey Salgado said they have yet to receive a copy of the decision.

    Nonetheless, he said “Makati’s claim on these areas have historical and legal bases. We have always maintained they are part of Makati and we are glad that the CA has upheld our jurisdiction.”

    The Court of Appeals noted since 1970, the national census had already included 7 military barangays-- (Cembo, South Cembo, East Rembo, West Rembo, Comembo, Pembo and Pitogo) as well as the Inner Fort barangays (Barangay Post Proper Northside and Barangay Post Proper Southside)-- as part of Makati’s jurisdiction.

    Bonifacio Global City is also part of the Inner Fort.

    The appellate court’s decision reversed the Pasig City Regional Trial Court’s order invalidating Presidential Proclamation No. 2475, which shows Makati’s jurisdiction over Fort Boni.

    Also upheld by the CA is Proclamation No. 518, which modified the PD No. 2475.

    “Hence, Presidential Proclamation Nos. 2475 and 518 did not alter boundaries instead confirmed that said area is under the jurisdiction of Makati,” the CA ruled.

    The CA also noted that residents in the areas mentioned are Makati voters.

    It also stressed that Taguig belatedly filed a complaint against Makati in its claim over the areas.

    Proclamation 2475 was enacted in 1986, and Proclamation 518 was created in 1990. Taguig filed the complaint in 1993.

    Quoting the Supreme Court, the appellate court said the “considerable delay in asserting one’s right before a court of justice is strongly persuasive of the lack of merit of his claim, since it is human nature for a person to enforce his right when same is threatened or invaded.”

    Taguig City can still appeal the ruling.

    Seeing how much Fort Bonifacio can generate business taxes coming from corporations, I won't be surprised if Taguig appeals that ruling. Naawa na ako sa mga residents ng Fort.. sa 2000s yun address nila "Makati City" tpos naging "Taguig".. ngayon "Makati City" nanaman. Must be a massive PITA.

    wag lang nilang lagyan ng coding ang streets ng BGC. hassle yan para sa nagwowork sa ospital. ~___~

    Well from my understanding BGC is still a "privately owned" area, that's the reason why there isn't coding there in the first place. Let's just hope they don't enforce Makati-style traffic rules there!

    To me this is just another tax money interest issue.

    Makati and Taguig are both vying for the tax revenues from BGC. Even some corporations relocated to BGC for the tax breaks and escape from Makati's tax system.

    ^ very true. Once makati has taken over bgc, bpo companies will most likely shift to "business friendly cities". Kaya better to sell of condos meant for rental then see the slow decline of expats renting.

    Igaya na lang nila sa senate presidency,term sharing para walang away.since every 3 years local election,1.5 years kay binay ,1.5 kay cayetano ,that way everybody happy,lalo na mga nasa home along the esteros,

    I don't have any against the decision of court of appeals. Ang sa akin lang, sure ball naman na mag appeal pa ang city of Taguig eh. Baket etong si Junjun agad agad i-take over ang BGC? Hinde ba dapat hintayin na lang muna ang decision ng supreme court bago gumawa ng hakbang?

    mag-a-appeal daw ang taguig sabi sa balita, pero ang akin syempre sisimulan na ng makati yan hindi na hihintayin yung appeal. pano kung di mag-appeal eh di parang naghintay sa wala.

    I think it would be in the best interest for everyone to leave BCG to Taguig. Its bad for business that you have 2 business districts all under the jurisdiction of Makati. There will be less competition and reduced benefits for the residents of Taguig. Instead of spreading the wealth, you will let one single city where most of the rich already live, get more.

    If it is technically under Makati, Pnoy should step in and redraw the lines.

    I will not be surprise if the SC will rule in favor of Taguig. Cayetanos are now in the yellow side of the fence.

    i thought privately owned ang BGC? bakit humihirit ng number coding ang makati?

    Once Makati takes over the BGC, Binay said they would implement number-coding scheme, plastic and smoking ban in the area, which are being implemented in Makati City.
