sakaling bagong issue o new creation nila at in doubt ang legality.. it will end up in Supreme Court (kung may maglakas loob na mag raise nito)... we all know how Supreme Court is running the pace on these cases.... by the time na mag labas sila ng ruling... baka senador na si Bimby...
analogy ko... noong dati tinitira nila si Corona... even the Supreme Court as an institution... na tipong pinakikialaman nila yung Financial Independence ng Supreme Court and Judiciary... lumabas dati na hindi pinupuno yung mga vacant judge positions.. para maka save.. and then the savings realigned as additional benefits ng judiciary....
parang same lang...
savings from executive agencies... na realign... for their own purpose.. which is to "strengthen" legislative liaisons... para sure ball ang mga agenda nila...

in the past.. malinaw na kapag di napasa ang budget... previous years budget stand... so kung di napasa ang 2012 budget.. 2011 budget allocations will apply for 2012... or until the 2012 budget is passed... malinaw yan.. and during the last few years of Arroyo administration.. lagi nga reenacted ang previous year budget.. di natatapos ang budget on time...
pero sa Aquino admin.. ang aga matapos ang budget.. trina trabaho talaga.. yun pala may DAP hehe..
sa kabilang banda... ang di pa malinaw (at least sa akin.. ewan ko sa inyo)... kung pwede ba talaga... na EXECUTIVE.. without any enabling law (whether specific law for that specific purpose.. or general law)... can executive realign the savings and use it for a different purpose?
malinaw na savings in executive go back to treasury.. pero by end of year ano mangyayari sa mga savings na yun.. di ba it makes sense na isama sa next year budget? then sa next year budget.. naka line up mga allocations... so dapat.. pati yung savings from previous years... may provisional allocation... possible by order of priority depending on the amount of savings...
i think yun ang point ni Joker... kailangan may specific law listing and providing for the allocation of a fixed amount (which is the savings) to particular projects , etc... sa nangyari with DAP... okay may savings... pero without informing congress or the public officially... na may savings... nilabas agad nila yung pera para panggastos.. well in the traditional sense... all the money that government should spend should be programmed.. kaya nga may national budget eh... so dapat.. savings should also be budgeted and allocated properly kung saan mapupunta..
which in this case sa DAP.. it seems... hindi naka program BEFOREHAND yung pagpupuntahan ng savings... ang nangyari.. since they had funds to disburse... nag allocate na lang agad... hindi dumaan sa traditional process... which is through congress...
at least... yan ang analysis ko sa issue....

Pina gulo lang kamo. Mas malaki ang issue ng PDAP, now since may tama talaga sa ulo mag isip ang mga pinoy kung ano yung latest eh yun na. And what's the latest? DAP.
Now going back to the case of Joker... Sabi nya bribe daw, ngayon yung nahuli na sya pala ang nag request eh illegal naman daw.

Now every pinoy wants the head of pnoy...he gets impeached or resigns..binay rises to the occasion..everybody gets a win win deal with him for the sake of unity..we forget the issue..

MANILA, Philippines—“This administration does not and will not use public funds entrusted to us by the Filipino people to bribe or coerce any individual or group for any given purpose.”
Budget Secretary Florencio Abad issued this statement on Tuesday amid a spate of criticism that a little-known facility, known as the Disbursement Acceleration Program (DAP), had been used to bribe senators to convict Chief Justice Renato Corona in May last year.
“Designed and implemented as a spending acceleration mechanism, the DAP was launched by the Aquino administration in October 2011 to support fast-moving projects that would help the government catch up with its expenditure targets,” said Abad, who is attending a governance conference in Burma (Myanmar).
“The Aquino administration has consistently and faithfully used DAP according to its design, which is to maximize the utilization of national government savings and further enhance the country’s economic expansion,” Abad said.

PNoy challenges critics to impeach him
MANILA – President Benigno Aquino III reiterated that the release of funds under the disbursement acceleration program (DAP) is legal and challenged critics to impeach him over its alleged misuse.
"Isulong nila kung palagay nilang nasa tama sila. Pero kakabasa ko lang sa Constitution, merong authority sa savings to put to other uses basta nandoon sa ating budget," Aquino told reporters when asked for his reaction to reported statements of former Senator Joker Arroyo and Senator Miriam Santiago that DAP is illegal.
Aquino also denied using the DAP as a means to bribe or reward senators for voting to convict former Chief Justice Renato Corona.
He pointed out that Corona was convicted in May 2012 while funds under the DAP were not released until October.
"So meron bang bribe after the fact?" he said.
Aquino said that the DAP was meant to spur public spending amid observations that the government was not spending much.
He also took exception to his being called as "pork barrel king" by critics.
He said that his administration has been careful in using public funds adding that the budget has been enacted on time to minimize room for corruption.
He said that he has abolished priority development assistance fund (PDAF) system and has been using the Malampaya funds strictly for energy-related projects.
Aquino said,"Tinanggal ko na naman 'yung kakayahan ko na mamudmod, 'di ba, binawasan ko. Walang namilit sa akin 'yan. Walang nagturo sa akin 'yan. Walang nag-insist 'di ba. Pero ginawa ko. So marami na akong ginawa e. Tapos tatawagin nila akong pork barrel king, medyo sa totoo lang, executive ang... gagastos ng national budget, napaka-ingat natin kung papaano gastusin dahil kailangan nating mapagtanggol at anytime kung sino man ang kritiko na tama ang paggugol ng kaban ng bayan."
