This case is why we should really push for the de-criminalization of libel. But also, a review of how and why the warrant was issued so readily when Menorca's camp claims they didn't even receive a summons for the charge.

according to reports, the W/A was based on a libel case filed in marawi city.
it is possible that menorca did not receive for one reason or another the summons issued by the city prosecutor of marawi or the provl prosecutor of lanao del sur for him to file his counter-affidavit to the libel charge. if that was so, the investigating prosecutor was left with no other recourse but to resolve the complaint against him on the basis of the evidence presented by the complainant.
it goes without saying that the resolution of the investigating prosecutor would be adverse it menorca. so much so that when the former filed an information for libel, the court, as a matter of course, issued the W/A. menorca is not without recourse here. he can file with the court a motion for reinvestigation, post bail, or file a motion to quash the W/A.
what boggles the mind is the dispatch the W/A was served and the people behind it.
MPD Station 10 commander, Superintendent Edilberto Leonardo, is a member of INC.
"In an interview with GMA News, Leonardo said that he received the warrant of arrest on Tuesday night from a member of the Iglesia Ni Cristo."
"Leonardo had admitted that he is also a member of the religious sect. He said that he did not personally know the Iglesia member who gave him the copy of the arrest order."
i am not a conspiracy theorist, but i smelled something is amiss here.

What's bogus for me are the following circumstances of the service of the warrant:
1. The policemen who served the warrant did not wear proper uniforms, or were in civilian clothing and were armed
2. Allegedly, they did not provide a copy of the warrant to the lawyer of the accused who demanded to see it. Supposedly, the warrant of arrest bore only an alias associated with Menorca (does he even use an alias?)
3. Allegedly, they did not read the accused his rights under the Miranda doctrine
4. The arresting officers declined to identify themselves
Medyo mahirap ata yan kung papanigan ng huwes. Menorca should not post bail and instead have the warrant quashed for the circumstances aforementioned.
a piece of advice:
if you're arrested (knock on wood) or any of your relatives or friends, you video the whole process. this is so because mere failure to read the Miranda rights (the right to remain silent and to have a competent counsel of one's choice) to the person arrested is punishable under section 4 (a) of republic act 7438--
Section 4. Penalty Clause. – (a) Any arresting public officer or employee, or any investigating officer, who fails to inform any person arrested, detained or under custodial investigation of his right to remain silent and to have competent and independent counsel preferably of his own choice, shall suffer a fine of Six thousand pesos (P6,000.00) or a penalty of imprisonment of not less than eight (8) years but not more than ten (10) years, or both. The penalty of perpetual absolute disqualification shall also be imposed upon the investigating officer who has been previously convicted of a similar offense.
the reading of the Miranda can be dispensed with if there is an imminent danger to the life and limb of the law enforcers serving the warrant.
Below is Sec. 5, Rule 14 of the PNP Operational Procedure relative to service of W/A--
SECTION 5. Procedures in Serving Warrant of Arrest
a. Verify the validity of the warrant and request for an authenticated
copy from the issuing court ;
b. In serving the warrant, the police of!cer should introduce himself
and show proper identi!cation;
c. Make a manifestation of authority against the person to be
arrested;
d. If refused entry, the police of!cer may break into any residence,
office, building, and other structure where the person to
be arrested is in or is reasonably believed to be in, after
announcing his purpose;
e. The police of!cer need not have a copy of the warrant in his possession at the time of the arrest. If the person arrested
so requires, the warrant shall be shown to the arrested person as
soon as possible;
f. Secure the person to be arrested;
g. Conduct thorough search for weapons and other illegal materials
on the person arrested and surroundings within his immediate
control;
h. Inform the person to be arrested of his rights under the Miranda
Doctrine.
i. No unnecessary force shall be used in making an arrest;
j. Con!scated evidence shall be properly documented;
k. Bring the arrested person to the Police Station for documentation;
l. Make a Return of Warrant to the court of origin(Form “B” -
Annexes); and
m. Deliver the arrested person to jail/prison upon the issuance of a
commitment order of the court.
