    Empleyado po ako ng isang IT outsourcing company. Contractual lang po ako. Contract po ng company ko sa client po namin ay hanggang Oct 18, 2010 po. Yun din po kontrata ko sa company ko,dun po ako naka-asign sa client po namin. Nakatakda po ako umalis papuntang abroad sa Oct. 27, 2010 kaya sabi ko po sabi sa company ko hindi na po ako magrerenew ng kontrata ko, hanggang sa Oct 18, 2010 na lang po ako sa company. Hindi po ako pinayagan kelangan ko daw mag-render ng 30 days kung hindi, hindi ko po raw makukuha back pay ko kasi kelngan daw nila humanap ng kapalit ko para sa client namin. Pero bago po matapos kontrata ko hindi naman po nila ako tinanong kung gusto ko po magrenew o hindi na. Sa Oct 18, 2010 po tapos na po kontrata ko. Ano po dapat kong gawin? Salamat po

    Do not renew your contract period. They should have asked you last month whether you will still renew your contract or not.

    dont renew. wala silang habol sayo. 3 years din ako consultant. kung mawalan nga ng client wala teterminate ka din nila kagad eh. nangyari na yan sa isang ka officemate ko dati. sa kanya naman hindi siya kinakausap na rerenew siya. bigla na lang nag resign kasi may lilipatan na. ayun, badtrip ung client kasi hindi nila ineexpect. sa agency sila nabadtrip hindi sa ka officemate ko. hehehe. yung isa naman hindi rin kinakausap. bigla na lang sinabi niya hindi na siya mag rerenew. hehe. ayun wala din nagawa. basta ang usapan diyan is kung hanggang san lang yung contract niyo hanggang don ka lang may responsibility sa kanila.

    problema kasi ng mga marketing manager madalas nag eexpect sila na mag rerenew ka na kagad. o minsan tamad lang talaga. trabaho nila na iinform ka sa mga nangyayari. mahirap din umasa na irerenew ka kung hindi ka kinakausap. baka bigla hindi pala so san ka pupulutin.

    anong company if you dont mind?

    Meron po. Pero hindi po nakasaad na kapag natapos ko na ang contract kelangan ko pa din gawin yun.

    30 days notice is for resignation.. iba yang end of contract.. kaya nga may contract.. after the duration of the contract.. at hindi ka nag renew.. hindi na binding yan.. they can't hold you for 30 days.. wala ka na ngang contract eh..

    una, make it clear to them the facts:

    1. your contract ends Oct. 18, 2010
    2. even though the project does not end by Oct. 18, your contract still permits you to work with them only until Oct. 18.
    3. if they were expecting na mapapakiusapan ka nila to extend beyond Oct. 18, this is either through a renewal, or "pakiusap"... either way, they should've started the process of "pakiusap" or contract renewal talks way before
    4. granted that even for the sake of debate and discussion na pinakiusapan ka to stay on, it is still pakiusap, pagbigyan mo sila o hindi, it's up to you, it's your decision... subject to terms and conditions mutually agreed by both parties
    5. in effect the IT outsourcing company you are with works as an agency, it is their lookout to have redundancy in manning dahil usual naman yung ganitong cases ng turnover ng tao sa industry nila
    6. it is possible na panakot lang yung hindi ma release last pay and benefits mo, that is para mapilitan ka sa kanilang "pakiusap" to extend
    7. if they do manage to withhold your last pay, ikaw pa maghahabol sa kanila by filing a case sa NLRC...

    That clause only applies if you're going to resign. EOC yang case mo so the 30 day clause will not apply.

    Sabihin mo lang na you have not intention in renewing your contract, wag mong sabihing mag reresign ka.

    wala akong alam pagdating sa local labor contract setting.
    trying to ask here for my daughter, she's tied up until january 2023.
    she want to go out immediately to go abroad but she was told to pay up amounting to 2 months salary (nasa company regulations daw).
    no way out na ba ito except to pay? dagdag pocket money na sana yung 2 months salary.

    yan yung bond/agreement, for example may binigay sa kanya training na mag tatali sa kanya sa opis for a certain period of time. syempre lugi ang office kung aalis agad siya... kung may bond baka pwede installment bayaran...

    if that's the contract that she signed...
    puede bang installment or defered payment?

    but my more long-term worry is,
    what will be her standing in the company, in the future?
    will she be in their good graces, such that should she want to come back, she will be accepted with open arms?

    ang problema doc, need nya ng documents from this hospital for future use.
    wala na palang way out pag stipulated in the contract.
    kung hindi sana immediate yung alis dapat hanggang end of contract sana ang plano nya.

    Kung nagmamadali yun employer niya eh di sabihin sila mag shoulder or dagdag niya yun 2 months sa signing bonus.

    Allow me to share a secret bro...bonds are actually just deterents, but will not stop the employee from leaving without paying back bonus. However, the company may withhold last pay and will not be complied to issue a clearance.
