    my sis in law is in the US right now and wants to apply for a job. she went to an agency and was told that application for working visa only starts on Oct. 1. e upto september 22 lang ang legal stay nya sa US.

    questions:
    1. talaga bang oct. 1 pa pwede mag apply ng working visa? hindi ba sila nagaaccept ng application before that date?
    2. pwede ba syang magpa extend ng stay sa US? 3 months ang binigay sa kanya which will end on Sept 22.

    as far as i know .. you can't apply for a working visa in the US .. a US company can sponsor your visa application .. but you still have to return to the philippines and get the visa here .. you can't apply for a working visa outright without a sponsoring company ..

    A friend was in US last year as a tourist. While she was there, she tried to look for a job as a Caregiver or whatever available. What she had were part-time babysitting jobs from friends and relatives until she exhausted her 3-month stay there. She was not able to get a real job nor working visa. Nonetheless, she was able to recover her expenses for her tickets and had some money when she came back here.

    The first way is to find an employer who is willing to sponsor and apply for a work visa on behalf of the applicant. Oct 1 is the start of filing of applications. A lawyer does this. The application is reviewed by the USCIS, and if approved, will notify the embassy where the applicant will go to have the visa stamped, as well as the employer. There is a limit on the number of visas to be granted, set by the US gov't and varies usually year to year.

    The second way is to go there as a tourist, find a Filipino employer who is willing to take the risk of employing a tourist, and hire a lawyer to process the work visa for a fee. Sometimes the tourist will really need to come back to the embassy for the interview and stamping. I would of course advise against this.

    .. dati ata pwede .. nalala ko my mom stayed there for a year ata .. pero this was pre-9/11 .. after 9/11 .. na-kwe-kwestyon na yung mga extension ..

    Kung plano nya mag pa extend ng stay she has to file it right away, it takes about 2 months to process the extension. I would suggest to get a lawyer to do this.

    Mine was submitted on Sept 24, but the USCIS will start reviewing the apps on Oct 1.

    According to Atty. Gurfinkle, slim chance ang extended visa. Atty. Gurfinkle also said "A tourist was given a 90-day, isnt that enough to see the United States?" If she overstays, she'll be in a blacklist. A day of overstaying is an OVERSTAY.

    Boybi, is your sis in law is a qualified Nurse, then she has a much bigger chance.

    Consultation ni Atty. Gurfinkel (Makati Office) ay $330 and that was a year ago. Atty. Reeves is much cheaper. Pero mas believe ako sa skills ni Simon and Gurfinkel. :D

    Oct. 1 is the start of processing BUT...there are already applications queued to INS on a year round. In reality, exhausted or quota na ang H1B or working visa when the Visa queues start processing sa naka-pending pa lang. So, kung Oct. 1 pa lang ang filing, chances are next year ang result ng Visa application. Pero meron naman nag-sponsor na company sa US as long as na you are fit for the job and their qualifications and you don't have to go back in Manila just to get the working visa. I already known few who had their luck with this tactic.

    my brother-in-law came there as a tourist Dec. 2002 and dun na sya nag-apply ng working visa. he just extended his stay legally and consulted a lawyer and yun na din tumulong mag-process ng application nya. $4k yata nagastos nya including the lawyer's fee. di na din sya pinauwi dito while the working visa was being processed and eventually approved...

    oct 1 nga ang start ng filing of applications but before the day's end ay na-reach na agad yung quota w/c is 4k (or 40k) per year lang. this is because lahat yun ay pre-filed na ay hinihintay na lang yung actual date to formally start the process.. last month lang ay lumipad na papuntang US yung 2 anak ng bayaw ko (both minors) w/c he petitioned as dependents...

    much better if she seek the help of an immigration lawyer..

    Most Pinoy immigration lawyers in Los Angeles will even help you find a sponsor, at least have the $5,000 ready. Oh, mas mura kesa pakasal :hihihi:

    if she have a sponsor, and the sponsor applied for a working visa for her, does she still have to extend her tourist visa? or mas malaki na ang chance para ma-extend ang tourist visa?

    According to Atty. Gurfinkle, there is no need to apply for an extension. The papers for employer sponsorship is sufficient to make her stay in the US legal.

    Medical field pala sya, mas malaki ang chance nya na makahanap ng sponsor. Of course we cant assume na Doctor agad agad ang labas nya sa US.

    I hope this give you and idea, but its better for her to consult a lawyer.

    aside from garfinkel, meron ba kayong marerecommend na lawyer na ok at hindi manloloko? she's staying in pasadena, california now. meron na daw syang nakausap na lawyer and ang sabi sa kanya hindi daw sya pwde kasi upto sept 21 lang ang legal stay nya tapos oct 1 pa ang start ng pagprocess ng working visa. ano ba talaga? kapag meron na syang sponsor and application for working visa, automatic na bang pwede sya magextend ng stay nya?

    Every weekend, I do watch TFC's citizen pinoy. There are a lot of Pinoys on the show who was lead to believe about a lot of things, wala nang pag-asa etc. Pero pagdating kay Gurfinkle bro, lusot lahat...legally.
