As you said you are willing to pave it and if it happens that the lot owner likes the improvement and considers the same as necessary, then a relationship called Negotiorum Gestio is created. So if he wants you to pay for the rent before the court, then you can ask the court for a just and reasonable rent payment. Offset it with the expenses on the improvement.
