I take Ceres at times when i'm in Iloilo and Negros. I agree that their buses are well maintained and the drivers are safe. I even take the no-AC buses at times (when i don't wanna wait for an a/c bus anymore).

Bus accident na naman, NLEX naman, although this time mukhang kasalanan ng dump truck.

MANILA - The driver of the ill-fated Don Mariano passenger bus that plunged from the Skyway on December 16 died Monday night, his relative said.

Carmelo Calatcat was confined at the Intensive Care Unit of the Parañaque Doctor's Hospital when he passed away at around 6:43 p.m., according to his cousin, Efren Risomadero.

The hospital has yet to issue an official statement on Calatcat's cause of death.

Calatcat's live-in partner, Ledelyn Mondelanget, was at the hospital when the bus driver died.

He left behind 3 children living on Dinagat Island.

Calatcat was able to move his hands in previous days but his health suddenly turned worse, according to Mondelanget.

He was charged with reckless imprudence resulting in multiple homicide, multiple physical injuries, at damage to property on Tuesday following the death of 18 people in the accident.

His remains will be brought to Bicutan. - report from dzMM

Face it, the guy got away scott-free, and the victims are left to pick up after his mess.

Since the decease cannot defend himself...waste of taxpayer's money.

Subong said the determination of the driver’s guilt is crucial to the civil case filed against the bus owner.

As far as I've heard sa news, they can't be held criminally liable, though for a victim you can file for civil liabilities. From the news article, it seems they've done so already and the filing for the dead driver is to support the civil case (esp. if found guilty).

AFAIK, death extinguishes whatever criminal liability there is of the accused, so the case against the bus driver will likely be dismissed.

The only option for the victims is really to go after the operators of Don Mariano. Actually, they may have an easier time proving their case since its civil in nature and there is presumptive negligence on the part of the operator since it is a common carrier.

All you have to do is: (i) prove the deaths were due to the incident (i.e. bus falling off the skyway); and (ii) there were prior instances wherein Don Mariano buses were involved in damage to property or injury to its passengers. Pretty much an open and shut case. If I were lawyering for Don Mariano, stipulation na lang as to the facts para wala ng proof regarding exemplary damages.

Ang kalaban lang naman dito yung mga nagpapa-settle kaagad ng kaso (bayad), tapos quitclaim na.

No wonder kayod to the max. Dalawa pala family susuportahan. RIP to the driver but the victims need justice to be served.

May nasunog na bus sa slex the other day.

    Peace out!
