Since the decease cannot defend himself...waste of taxpayer's money.

Subong said the determination of the driver’s guilt is crucial to the civil case filed against the bus owner.

Face it, the guy got away scott-free, and the victims are left to pick up after his mess.
AFAIK, death extinguishes whatever criminal liability there is of the accused, so the case against the bus driver will likely be dismissed.

The only option for the victims is really to go after the operators of Don Mariano. Actually, they may have an easier time proving their case since its civil in nature and there is presumptive negligence on the part of the operator since it is a common carrier.

All you have to do is: (i) prove the deaths were due to the incident (i.e. bus falling off the skyway); and (ii) there were prior instances wherein Don Mariano buses were involved in damage to property or injury to its passengers. Pretty much an open and shut case. If I were lawyering for Don Mariano, stipulation na lang as to the facts para wala ng proof regarding exemplary damages.

Ang kalaban lang naman dito yung mga nagpapa-settle kaagad ng kaso (bayad), tapos quitclaim na.

the truth is, no amount of laws and regulation could have prevented it.

even if the government decides to be stricter, it'll happen again after a few months. that's filipino culture.

why would I wear seatbelts? it's uncomfortable and it's inconvenient.

what's a storm surge? pfft! that's nothing, I'll just stay in house.

why do I have to wash my hands? wala pang 1 minute ha

why should I avoid padpad? wala pa naman ako nararamdaman e

why shouldn't I sell my vote? pogi naman siya and what could possibly go wrong? di ko naman pera yung hawak nila.

I think properly recapped tyres are quite okay (Bandag?). Ukit is definitely a no-no.

Those idiots skimp here and there, and try to maximize earnings... and cause more in damage to lives and property.

madami akong nakikitang bus/trailer truck with dubious tires, a few times me bitak bitak na sa sidewall. Madami rin gumagamit ng cheap China brand tires but i haven't seen them lately.

Kada rehistro kasi dapat, may 20- or 50-point vehicle inspection. Tapos gawin mo every 3 years din. Pag sablay sa emission, sablay sa safety yan lahat, dapat on the spot, may assessment for (stiff) penalties.

Tapos, kung may aksidenteng ganyan, dapat may kasamang demerit yung corresponding officer(s)-in-charge of that (bus) company. Deretso sa 201 file para damay lahat.

This means the annual re-registration/safety check by the LTFRB and LTO is a BIG FAIL...

All but 1 Don Mariano buses fail first wave of road-worthiness tests - LTO
By: Likha Cuevas-Miel, Jaime Sinapit and Dexter San Pedro, InterAksyon.com
    December 17, 2013 1:45 PM

(UPDATED - 3:29 p.m.) MANILA, Philippines -- All but one of the 23 Don Mariano Bus Lines units covered by the first wave of road-worthiness tests conducted by regulators failed the examinations Tuesday, a day after one such bus crashed through the Skyway railing in Paranaque City and fell to the service road below, killing 18 and leaving 20 others injured.

This developed as Land Transportation Franchising and Regulatory Board (LTFRB) Chairman Winston Ginez said the board is not discounting the possibility of cancelling altogether the franchise of the Don Mariano Transit Corporation over Monday’s deadly fall. The ill-fated bus also hit a closed van, the drive of which died instantly.

The bus driver, Carmelo Calatcat, is still in critical condition in a hospital.

On Tuesday, the Land Transportation Office (LTO) conducted a battery of tests on the first batch of the Don Mariano fleet of 78 buses, which the LTFRB ordered grounded for 30 days hours after Monday’s tragedy.

Joel A. Donato, LTO's chief inspector, told InterAksyon.com that most defects found in the company's buses were: broken headlights, signal lights and tail lights; worn out tires; broken windshields; broken wipers; and missing wheel studs.

Donato said the LTO gets to inspect these vehicles only once a year when the management applies for registration.

This is complemented by inspections conducted by the agency in bus companies' own garages before commuters start their exodus back to their home provinces before the Holy Week, All Saints" Day, school semestral breaks and Christmas Holidays.

The LTO also deputizes several government agencies on the road to conduct inspection of public utility buses such as the PNP-TMG, road officers of SLEX & NLEX and other motorways, and the MMDA.

LTO inspections are only good for 60 days.

Earlier, Ginez said the board immediately stopped the fielding of 78 more Don Mariano buses for 30 days shortly after the incident.

The LTFRB has been meticulously assessing the viability of the company as bus operator in Metro Manila considering that it has already records of accidents such as in July 2012 that injured several passengers and in August 2012 that killed a motorcycle rider, according to Ginez.

He said they have set a hearing of the Don Mariano Transit Corp’s. case on January 7, 2014.

Kapintura nila eh. Parang MGE at Green Taxi?
