tama, get a copy of the warrant of arrest and sue the fiscal for illegal detention and conspiracy in kidnapping. report him also to the bar council and have him de-barred for ignorance of the law.

bailable yan P2000 pesos lang, kahit sinong abogado hindi dapat nakulong aunt mo. ginapang (binayaran) yan ng bading sa fiscal dahil walang nagyaring arraignment sa aunt mo at ni walang subpoena as per your info (pero sigurado ko meron yan subpoena at iba ang pumirma). Labag sa batas yan without due process at alam yan ng Atty ninyo... maliban lang kung peperahan din kayo ng ATTY... keso mahirap, ganito.. kailangan.. pera... etc. anong 50/50 na sabi ng atty? get another atty kung ganyan agad pananaw sa case.
same case kasi nagyari sa pinsan ko, walang kaalam-alam may warrant of arrest dahil estafa din ikinaso take note mas mataas pa sa P21T, sinamahan agad ng atty pinsan ko sa fiscal then paid P2000 bail, kumuha ng case copy then file sila ng motion na ibalik sa prelim ang case dahil walang nangyaring due process, nanalo sila at dismiss yung case dahil hindi naman niya tinatakbuhan yung utang niya babayaran naman as per their previous aggreement nung nagsampa ng case.

May anomalya nga dyan. 21K lang ang money involved, masyadong maliit.

You cannot be jailed for estafa. Either the attorney you got is trying to swindle you or there is another side to the story which your cousins are not telling you.

May 14th, 2006 12:37 AM #20how i wish i can talk to the fag and ask him? her? errrr it, to teach me a thing or two on how he pulled off a non - bailable case with just a debt 21,000 :D
in our business, collecting debts is like a wild goose chase hell we even have a company lawyer who handles all the collectible accounts but still after the tedious process it is just settled with measly bail.... then after a few months the process is just repeated...talk about the never ending story...
sadly we learned the hard way suntok sa buwan kung makasingil ka anyway we learn from our mistakes so to avoid all these "huwag magpapautang walang cash walang goods" kaliwaan lagi dapat :D
note: walang nakukulong sa pilipinas dahil sa utang ang daming loop holes ng batas
