    I have a property being rented out. 2 months lang ang deposit, and as of now, 3 months na syang hindi nagbabayad ng rent. Can I evict the tenant anytime? Or do I need to go to court pa?

    May contract ba kayo sir? ano stated pag hindi nakabayad?
    Kami nun dinaan muna namin sa barangay, Meeting muna with the tenant, make arrangements and compromise para naka record and may witness.

    Baranggay mo na yan kahit walang time constraints sa contract para meron na record.

    Send a demand letter. Preferably from a lawyer or law office. Thats usually enough to make them pay. If after the time specified in the demand letter lapses, and they still refuse to pay, you have legal grounds to evict. I'm not sure but I belive eviction can be done with the presence of barangay officials. Best to have the barangay cap or at least tanods present when evicting. At the very least you have witnesses, they will also prevent "gulo"

    Try to video tape the eviction so if they become violent, you have evidence.

    Eviction is never easy. Be prepared to just let them go and loose the 1 month rent. They may even ask you to give them time to look for a new place.

    san ba yan, sa quezon city? kung sa qc, 1st question nyan sa barangay ay kung may permit ka sa barangay or city hall na magpa-rent ng property. commercial man or residential need mo ng permit, for tax purposes. pag wala hindi ka nila tutulungan, di nila i-schedule ang hearing nyo ng tenant sa lupon.

    ganyan din ermats ko may pinapaupahan siya na 1 commercial. may contract, stated sa contract na pwede paalisin after 2 notices. pero di maisampa ni ermats sa barangay kasi nung nagpunta ako yun una ask nila, dapat daw pag sign pa lang ng contract of lease pinasok na sa barangay ang copy para nakakuha ng permit. pag wala daw, on your own ka. at least naman yung tenant ni ermats e magbabayad na, sa wakas.

    demand letter lang yan sir, pag di nasindak. putulan mo ng tubig or padlock-an mo. i always believe in almost all circumstances na 'it's just a dog eat dog world, if you dont eat them they'll eat you' in your case, if hindi ka magmamatigas. makakalibre lang yan renter/leasee mo. stay firmer than them.

    just my 2 cents.

    *yebo, sa Tarlac. And nagbabayad ako ng withholding tax sa rental. 3 months na this sept hindi nagbabayad.

    Nangako sila until next week, magbabayad daw. If not, baka demand letter na nga lang padala ko. Yun palang mismong nagrent taga Isabela pa. Katiwala lang yung nandito, kanino ko papadala yung letter?

    hangat di sila umaalis...wala ka naman sabit kasi wala naman silang ibidensya na kayo gumagawa non ;)
