    Yup unconstitutional to give him a violation, let alone a driving ban based on that.
    I wonder if there's any law firm who'll take up his case, but this seems like it should be slam dunk.

    agree. pero his license is still suspended and he has to attend an LTO hearing.

    kahit manalo sya in the end, naabala pa din sya. I don't think the LTO will compensate him for the days na naabala sya

    Yes, wouldn't that mean that the law itself is unconstitutional and at least a section of it will need to be repealed?

    Far as I know the constitution and bill of rights takes precedence over any law.

    That's my interpretation. Though, I'm not an attorney.

    Maybe actual lawyers in this forum might be able to shine some light onto it.

    IMO, as much as I want misdeeds to be punished, I think they're doing it in a manner that can be described as government overreach. And it's eroding the rule of law. Again, I think they should ground their decisions on clear-cut guidelines.

    my biggest issue against what the LTO is doing is that the video/photo has to be viral before they act on it.

    sana may website ang LTO where we can upload photos/videos in private, tapos both the offending party and the owner of the media will be required to report to the LTO.

    that way, you'll think twice before sharing a photo since maaabala ka din.

    Parang twisted na kasi yung nangyayare sa batas ngayon na pati kung anong mga nakasaad sa constitution hindi na basta nasusundan. Not surprised though.

    We've seen this type of behavior before during the pandemic when people's rights were disregarded.

    It's one thing to ram one's car into another car out of rage (which is very bad) and another to ram into a motorcyle with a rider while speeding through a narrow residential/school zone street.

    It's bad enough to ram one's car into another car in a fit of rage, it's another altogether for a car to ram a motorbike at high speed through a narrow residential/school zone street.
