August 1st, 2005 06:50 PM #82baka naman may nag timbre sayo bro, kasi kung visual lang ang check point at di ka naman kadudadudang tao, no need ro search the car, kasi wala naman search warrant na naka issue. ilawan ka lng nga sa mukha, bawal na. malay mo kung di naman talagang pulis mga yon, at pag baba mo sabay sakay sa kotse mo, carnaper pala. kasi nga d2 sa atin di na natin alam kung sino ang tutuong pulis, pulis patrol walang plaka.hayyyyyy nakuuuuuuu

October 10th, 2005 11:07 AM #83Simple Rule: Do not bring any undocumented firearms in your person or in your vehicle unless you may have a legal and logical reason to do so. The use of a vehicle is to get you from point A to point B... that simple.
Not all police officers are “police patolas” or crooks. Not simply just because one sees a person of authority in uniform makes them the bad guys nor stupid. Nor does a person behind a flashy car make them a spoiled brat.
The SOP on a police checkpoint is to use the flashlight to make an initial visual sweep of the vehicle. The light on your face serves a dual function. One is for identification and the other is for the defense of the person performing the search. If you look or act suspicious the officer will perform a body search on your person, which is also the secondary SOP.
The law has flaws.
These may help you:
1. Ignorance is not an excuse of the law. Acting like a pompous spoiled brat often times agitates the persons manning a checkpoint. Do not give them an excuse to pop you. Your money is no good when you’re dead.
2. Currently only PTT are allowed and it only covers from the address of which you had registered your firearm and the address stated in your PTT. Of course, the serial number should match the ones in your documents.
3. Do not run away from a checkpoint if you have nothing to hide. These will only make the persons manning the checkpoint more nervous than you.
The average survey recorded in a single precinct of cases of undocumented firearms caught inside a vehicle is greater than the report of cases involving the use of it in terms of self defense.
Vehicles are definitely not an extension of your home. No matter how long you sent time with it. It is only a tool just like a firearm. It always depends on how one uses it.
This post is simply to enlighten questions you want to ask a police officer. These are facts and I have no intention of locking horns with anyone of you.
Always remember: Spoiled kid attitude plus fast car plus unlicensed firearm equals disaster.

Warrantless search of a moving vehicle is allowed only when it is not practicable to secure a warrant because the vehicle carrying the prohibited drugs can be quickly moved out of the area or jurisdiction in which the warrant must be sought. We have already clarified in a number of cases that this exception in no way gives the police officers unlimited discretion to conduct warrantless searches of automobiles in the absence of probable cause. When a vehicle is stopped and subjected to an extensive search, such warrantless search has been held to be valid as long as the officers conducting the search have reasonable or probable cause to believe before search that they will find the instrumentality or evidence pertaining to a crime, in the vehicle to be searched.
a lawyer friend is handy in this kind of situations.

October 12th, 2005 12:51 AM #86Natasatanas.....you were carrying a 9mm firearm with no Permit To Carry. you violated a law. im sorry to say this but you deserve to be in prison. kung nasa US ka, kulong ka.....kung ang plastic toy gun nga eh bawal magbenta, totoong baril pa kaya kahit na blank bala mo.....buti nasa pinas ka na walang batas-batas dito...buti na lang hindi ka masamang tao na holdupper or kidnapper.....eh paano kung holdupper or kidnapper ka pala? eh di kawawa naman magiging biktima.....
huwag sana tayo magalit sa mga pulis if they were doing their job......although i do get nervous when a policemen flag me down during checkpoints (dami ko na narinig na planted shabu/marijuana) , i applaud and i even salute them because a lot of hardened criminals with guns have been apprehended in the past...

October 12th, 2005 03:58 AM #87tama nga si moneywhiz.. dapat may permit to carry ka the weapon kasi kahit nasa car yan hindi purket pwde na kahit nga din sa bahay lang ang weapon sa bahay lng talaga di pwde dalhin sa labas.. another story is kaibigan kung doctor na may brother na mayor dito sa cebu papunta sya ng sm diba checkpoint talaga yan pag ka pasok ng mall nakita ng guard yung Armalite sa trunk waaa.. natakot ang guard tapos sanabihan ng guard yong friend ko na "sir ano to nasa likod ng car mo? sabi ng friend ko pababa sa kanyang sasakyan ay nakalimotan ko pala armalite ko na eh uwi sa bahay" akala ng guard kukunin ng frnd ko ang armalite nya sabi ng guard "sir wag mo kunin or hawakan yan kung hindi magkamatayan tayo dito" tapos ayun sinabihan ng frnd ko na relax lng bossing may permit to carry ako tapos pinakita nya ayun nakapasok sa mall frnd ko..
another story is classmate ko na muslim anak ng mayor ng cotabato may dalang baril kahit saan.. sa mall everywhere.. ibang klase talaga tong may connection sa goverment politicians kasi wlang angal kahit ni sino.. angal ba sila eh yong tatay nya mayor ng cotabato yong isang auncle gobernador yong isa nman nag run as senator pero natalo nman.. hay ibang klase powerfull talaga cla.. kaya pala yong iba gusto talaga pasoking potiko. hay nkoo.. malaking *** talaga..
basta pre mas mabuti na may license ka kung wla wag ka magdadala ng harmful weapons like guns ksi masakit sa ulo yan kapag na tyempo ng pulis..

October 12th, 2005 10:31 AM #88Let’s assume that you were the defendant on an illegal possession of firearms charge and your lawyer friend countered an illegal search routine which is just about the only defense on your case. The next defense move that I will be anticipating on your defense would be the illegally planted routine but we won’t get to that, would we? Because we will only deal with the given facts here and please bear with me and I would try to make this easy as possible for you.
FACTS:
1. The evidence in hand is the firearm found on your vehicle lacked the proper documents to support any legal justification on why you have it inside your vehicle. These made it illegal from the very start from which it was you who initially broke the law.
2. The person(s) manning the checkpoint were there on purpose. It is also in their discretion and judgment if they want to flag down any vehicle going thru the checkpoint. Whether you were tipped off in advance or you were really acting suspicious is already out of the question.
3. The planted routine cannot be presented because the evidence really belongs to you on the first place and whose name also corresponds with having the same on your Firearm License Card.
4. You will be asked questions that wouldn’t be on your advantage because it you who broke the law, remember?
5. The arresting officer(s) would definitely be testifying against you and they will only say they were simply following the COMELEC Gun Ban Law. This is where you lose your case and just forget the illegal search routine because the said law protects the arresting officers(s).
