    They cant declare it as carnap? Because they willfully provided cars for car-rent business, right? They can't use the insurance for this reason.

    They can file case probably, estafa given that they have been issued with bouncing checks and they have been notifying those scammets with post-registered notice.

    I assume lang po, that most victims will be the dealers also. They are the ones who usually offer low dps. Because with banks, they tend to be particular with payment capacity and the required minimum dps.

    there is no carnapping because, like theft, there must be unlawful taking of a motor vehicle in carnapping.

    no estafa because the issuance of the check is made in payment of a pre-existing obligation. please take note though that mere issuance of a worthless check is an act punishable under BP 22.

    however, take note of the following provisions of the revised penal code which penalize :

    (1) any PERSON who shall bring or remove a mortgaged vehicle to any province or city other than the one in which it was located at the time of the execution of the chattel mortgage, without the written consent of the mortgagee bank;
    (2) any MORTGAGOR who shall sell or pledge motor vehicle already pledged, or any part thereof, under the terms of the Chattel Mortgage Law, without the consent of the mortgagee bank.

    Article 319. Removal, sale or pledge of mortgaged property. - The penalty or arresto mayor or a fine amounting to twice the value of the property shall be imposed upon:

    1. Any person who shall knowingly remove any personal property mortgaged under the Chattel Mortgage Law to any province or city other than the one in which it was located at the time of the execution of the mortgage, without the written consent of the mortgagee, or his executors, administrators or assigns.

    2. Any mortgagor who shall sell or pledge personal property already pledged, or any part thereof, under the terms of the Chattel Mortgage Law, without the consent of the mortgagee written on the back of the mortgage and noted on the record hereof in the office of the Register of Deeds of the province where such property is located.

    Kahit na maggdefult yung borrower, di nila makukuha yung car at reposses. Evidence na kasi sya...

    Unless maclaim nila sa insurance company

    Ang hindi ko ma-gets ditto is yung pinag-sanglaan. Hindi ba nila binubusisi kung nasan yung OR/CR nung sasakyan? Diba't yan pinaka-importanteng dokumento ng sasakyan jan sa Pinas?

    May sinasangla sa kanila, pumayag agad? eto pera, akina yang sasakyan.

    Or baka may fake documents?

    Yung lawyer friend ko daming hawak na kaso na ganyan ngayon. Yan nga daw yung sinasampa na kaso ng bangko.

    It is too unfortunate for the victims. They were swindled and then they will battle bank's legal case.

    when someone offers you a near-new monty for only 200K... some buyers get really struck by dumbness and to hell with all caution...
