nagka heated argument ako sa ASBU makati last tuesday...
my car is 2012 model advie, maangas si g*G* ehh sakto mainit na ulo ko... sigawan kame kase ayaw patalo.. pagawa ko daw kotse ko sabi ko baket may kaso ba ako.. sige anong kaso ko.. Uminit ulo ko kase sabi ko late na ako sa work.. ang sabi sakin " ayan na naman eh late na naman" sabi ko "bakit nakita mo na ba ako ?"

that person doesnt even know clean air act and visual sign.. nung nagtangal na ako ng seatbelt at akong bababa na ako pumasok na sa usapan yung supervisor nila... inawat yung tao nya at nagsorry sabay balik ng ORCR. Kinausap ko yung visor nila sabi ko ang angas ng tao nya.

Good on you, Sir. So dahil inaway mo sila, ligtas ka na? Akala ko ba may violation ka? So in short, lokohan lang talaga. Kung sino lang kaya nila. Mga g*$#%*#$ yan!

Now, seriously for a moment Guys.

From a legal standpoint, if we wanted to be objective before going ballistic that what they're doing is pure harassment and extortion, what legal documents can we demand from them to prove that what they are doing is, well, legal?

Can we ask them to cite the specific law that they are supposedly implementing and show us the proof via documentation, and then shove the details back in their ignorant faces? Because, obviously, we won't stand for just their word. That's bullsh1t! They're bullsh1t! What about they're asking us to alight from our vehicles, is that legal? Police checkpoints can't even allow them in our cars, suddenly these untrained idi0ts get to sit in our driver's seats?

I'm not siding with these mofos. We definitely need to avoid them to be free from the hassle. God knows I want them choking on the jeepney and bus fumes that they're ignoring. But there's got to be some foolproof legal way to shame them into oblivion, realizing what they're doing has no leg to stand on.

The question on ASBU legality would be to which Gov. Agency or Department ASBU belongs. Baka fly-by-night agency na yan dahil redundant ang function with LTO emission test.

they belong to the LGU because the LGU is also mandated to implement the clean air act. the problem is they are doing selective implementation of the law with the objective of harassing private motorist. if they are serious in implementation they should also check the quality of fuels being sold in their jurisdiction, their equipment for testing should be calibrated, implement a no-smoking policy, and confiscate those barbeque stands in every corner of the street and deny the application for business permit of mang inasal, andoks, baliwag and sr pedro

May nabasa nga pala ako dati na yun mga pujs meron sila binibili na sticker woth something. It serves as immunity daw sa asbus for three months.

Pag tinaning mo din mga yan bakit puro private ang hinuhuli, ang laging sagot "schedule ngayon for private vehicles". Amf!

Can we demand that they then produce a copy of that ruling as well as the IRRs for it, else we walk away? I mean even the citizens of the Republic of Makati probably do not know of this, so aren't these so called cops duty-bound to prove themselves?

Hindi ata nila pwede i-override yun existing na clean air act. Nabasa ko lang dun sa copy ko nun na no city council/lgu can override it. Correct me na lang if I am wrong.

technically, all national laws go over local regulations so talagang hindi pwede yan. what a local government can do is to create supplemental laws that complement the national law for enforcement.

So, technically, they can only go as far as do the testing that the National law dictates, right? So if the testing threshhold is X%, they cannot make it XX% just because they want to do so?

Ang problema kasi sa Makati, pag may blessing ni mayor, wala ng pwedeng sumuway. Then may kapatid pa sa senate at ang masama VP pa ang tatay. Kaya kahit anong pa ang isampal mo sa mga ASBU na papers, it will serve no purpose to them kahit very clear naman that what they're doing is not about the clean air act. Papaalisin ka lang nila and on to their merry ways. Video lang talaga ang weapon sa kanila, un nga lang if you always pass at that area, lagi ka nalang inaabala ng mga yan.
