December 31st, 2016 01:36 PM #41thanks sa response sir *confused shoes, yung stipulated sa insured amount ko sa insurance is php470,700.00. based sa feedback dito and some other sites eh usually di nila ibinibigay ng full kung ano nasa policy naten (again, based sa feedback to sir). wala ng usapan if ibibigay bila in full ang amount kasi may only concern is nag-DP kami ng 30% sa unit (car loan) para mababa ang monthly amortization namen. so we got the unit back in March 2015, almost 2 years na kami nababayad at di naman sa pag-aano eh malaki-laki nadin ang nagamit naming pera. the problem is since loaned sya sa bank, i checked with the bank at may balance pa nga na almost 280k...so babayaran muna yun and whatever is left is samen mapupunta...parang ganon eh.

December 31st, 2016 01:44 PM #42thanks din sa response sir *kimbon, the reason being is inaanticipate ko na mas mababa ang ibigay ng insurance when they declared it as "constructive total loss". so mathematically sobrang lugi na ako considering na mas malaki yung nailabas ko compared sa bank balance ko at this time. last thursday, tumawag ang wife ko at ang sabi eh nasa head office na daw ang papers ko and waiting for the amount na isesettle nila so that prompted my wife to ask if how much by any chance and if pwede irepair nalang daw so sabi ng taga insurance na kausap namin, di na daw kasi considered as total loss. parang ang dating eh na "double whammy" pa kami kasi nawalan kami ng option to have it repaired nalang in case di magkasundo sa offer. sabi ng insurance eh pwede naman daw magcounter offer but then again, knowing how these insurance work, babaratin ka nila (again, based sa feedback online to). kasi kung di sila papayag na irepair at ayaw ko ng cash settlement, baka pwede ko nalang ipull-out ang unit ko at sa labas ipagawa, that way tuloy lang ang monthly amortization ko na mababa sa bank. yun nga lang, shell out ako for my own repair. any thoughts on this idea? i would appreciate kung may mga inputs kayo mga sir. i will try to post pics para malaman ko din kung possible ba na marepair pa 'to. thanks and happe new year to all

^With that condition, mukhang hindi rin papayag ang insurance company na total loss. Rapairable pa yan. Papalitan mo per panel at per frame. Huwag kang papayag na pitpitin lang.

December 31st, 2016 01:59 PM #45sir *confused shoes, nope, the insurance declared it as total loss daw and papers have been forwarded to the head office na and waiting for the offer. we will know daw by tuesday. my unit is stock/un-attended sa accredited shop nila since december 02, 2016 - untouched. waiting for their LOA then all of a sudden sasabihin nila na total loss and wala na kami option to have it repaired? my only concern is nabunutan ako ng inner axle (malapit sa tranny ko) so sabi ko, baka pwede isama and tranny kasi baka nabungi pagkahugot. ang sabi eh, pag ganon sir eh almost same na ang insured value sa cost of repair ng sasakyan dahil sa tranny ko which is almost 100k daw (MATIC user pala ako mga sir) so grabe ang dilemma sa amin at parang ayaw pumabor ng tadhana

May be, just may. It is only an offered option (by the agent) na pwede mong i-turn down. Maaring ang ibig nyang sabihin ay since almost aabot sa insured amount ang repair expenses, why not i-declare na lang nila as total loss.
I thought casa ang nagbigay ng repair quote, bakit nilipat sa accredited auto repair shop? Baka naman madali pati warranty ng oto kung sa repair shop ng insurance mo ipapagawa.
I think, it is you to decide or the bank kung total loss or repair hindi ang insurance company. Basahin mong maige yung insurance policy/contract. Based sa iyong kwento, mukhang talo ka nga kung total loss ang kalalabasan nyan.

pls read carefully your insurance policy baka lang may inconsistent sa assestment nilang total loss. also ask them what was their basis bakit total loss. AFAIK you did not mention if sino ang may fault sa accident. based on your replies I assumed it was your fault. but if its the other party then ibang usapan yan.

January 3rd, 2017 06:25 AM #48thanks for the reply sir *confused shoes, ang nagbigay po ng quote ay ang accredited shop kasi nung tumawag ako sa insurance to have it towed ay sabi ng insurance na dalhin daw sa accredited shop nila so dun nakatengga yung sasakyan. i think so that it is our prerogative whether we want to have it repaired or consider it as total loss. your statement above sounds above right but my wife was told that we don't have any other option but to settle it with cash after my wife inquired about having it repaired in the event we do not agree with the offer.

January 3rd, 2017 06:35 AM #49thanks sa reply sir *kimbon, there basis as per statement was "if we are about to include the tranmission, then the sum of the insured amount is too close to repair value so might as well consider it as total loss". my condition was, let's have it repaired without replacing the tranny first however, once we have tested it on the road at my umugong dyan sa tranny ko, obligado kayong palitan yung tranny so that prompted them to consider it as total loss. i said, that's fair enough right? no tranny issues after the repair then we're done kaso gusto nga nila ay total loss may be because of the possible back job in case there is an issue with the tranny. btw, sir *kimbon, i was on my way to work *around 3.30am in the morning December 02, 2016 when the incident happened. along mindanao avenue (tandang sora), a cement mixer truck suddenly cut me as he tried to overtake the van in front of him. no signal light, blinded by his right spotlight (kadalasan may ilaw na nakakasilaw ang truck na to). was running 70-80 as i had an open lane then when we were next to each other, he tried to overtake the van in front of him all of a sudden then that prompted me to manuever my wheel to the right to avoid contact with the truck. medyo ninerbyos din ako sa laki at medyo nabulag sa ilaw dahil sakto sa mata ko yung spotlight nya. lacking real estate, i hit the gutter and picture posted above showed the damage to my unit.

Since malapit na sa insured value ng oto ung qoute ng casa, offer sa kanya is hahanapan sya ni insurance ng same model at color na altis 2nd hand OR pay Him cash as stipulated sa policy. Cash kinuha ni opismate at hanap na lang kami 2nd hand na walang history of accident na civic naman.. LOL.
Anyway, If I were you. I'll settle my obligations and kunin ko na offer ni insurance, mahirap pag ganyang repaired na oto, baka after ilang months lalabas ibang sira. Or baka di na aligned pag tumakbo. Just get a 2nd hand unit na sariwa.
