July 27th, 2024 02:31 PM #51Those are badly worded policies, written by "dinosaur" old school lawyers who love to use legal "gobbledegook" trying to impress people with their knowledge. Its a form of grandstanding, in written form nga lang.
Colleagues who teach legal writing are more progressive nowadays in their outlook. Simplicity of terms, and the ability to get your ideas across with the least amount of words/sentences (which IMHO, I agree with) are now the norm

July 27th, 2024 02:39 PM #53Under certain circumstances, the insurance company is subrogated (substituted) into the rights of the insured if it pays out.
I presume in case of a total loss payout they get the rights to the wrecked car, and malamang nasa policy yun. I'm just not sure of the needed paperwork involved though.

have we noticed, ang haba-haba nang insurance policy.
i am sure the contents can easily be printed on one or two sheets of paper, using larger font pa.
nakaka-inis yung, "the first party".. "the second party"... etc...
bat hindi na lang, "the owner must do this, to be entitled to this"...

Oftentimes, legalese verbiage makes for a rigid and explicit communication whose sole purpose is to remove vagueness and unclear stipulations that can lead to misinterpretation.
It's the same with scientific and medical journals. They can opt to write it in layman's terms but they have to adhere to strict writing patterns to sufficiently convey complex ideas in a precise manner.

Btw, has anyone heard of any success stories from the use of the whole-car plastic bag? Parang wala...
To me, these could easily have sprung a leak, sa dami ng debris na dinala ng baha. I doubt these would stand such abuse. But maybe I'm wrong.
