January 26th, 2011 07:51 PM #21sir mark, there were actually no appointed administrator, she just suddenly proclaimed herself as the administrator in which she literally do all the requirements and processing. May nakuha na daw na 200k and 10k from which nasa posesion nya, siya muna daw ang maghahawak until dumating ang ibang pera from the insurance. What if verbal lang na sinabi nya na sya muna ang hahawak at mag manage and afterwards eh nagkaroon na ng hatian without there consent and knowledge? He cant afford kasi to get a leave since siya na ngayon ang umaako lahat pati sa mga kapatid nya.

Bro, Kung nasa right age na nag mga anak wala iba pwede mag claim as admin Ng family unless wala pa sa tamang age ang mga anak. Kung insistent young tita dapat lumina na Ng lawyer ang family to avoid further damage kasi ang mga may interest sa pamilya magaling gumawa Ng paraan at maghanap Ng mga docs (same sa family namin na kindling sa mana mga kapatid Ng mom).
Once na naka kuha yan Ng any claims eh baka mahirapan na friend mo maibalik kaya habang wala or less damage pa Lang nagagawa ng tita Nya eh get na sya lawyer

January 26th, 2011 10:26 PM #24His 27 years old being the eldest. Inaasikaso rin nya ang car loan ng dad nya kaya hindi nya maharap yung ibang bagay, siya na lang din ang nagwowork sa kanila. Nagpresenta na ako na humanap ng attorney to help them out. About din sa claims, the beneficiary is their lola, nalaman lang nila nung nilalakad na ang insurance.

Then the life insurance proceeds goes to your lola period.
Make an accounting of your dad's estate and tax liabilities.
File a claim with the SSS me 30000 burial benefit doon that you can use
to settle final expenses plus other terminal benefits.
And file a seperate claim on everthing.(family house, bank accounts, employee compensation etc.
I would expose them to the baranggay officials and your mayor,
(ask the opinions of your neighbors,another way to expose them)

sir, ask ko lang po paano ang procedure kung babayaran in full ang remaining balance then transfer to his name? Any ideas guys?

I was about to suggest what others have said.. no rights ang tita.. all rights go to the children. (also not sure if same applies if illegitimate.. di naman sila illegitimate di ba? kasal parents nila?)

I was going to suggest (for future reference na lang) people with legal problems like this listen to DZMM's De Kampanilya, forgot their new time slot.. parang before TV patrol na yata. AM Station 630 or if you have skycable DZMM Teleradyo. Atty Danny Concepcion routinely handles calls just like this one. marami kang matutunan about the law. You may even call and ask for free advice. Dami na akong naririnig similar case ganyan pinaawayan ang kayamanan pag may namatay... interesting stuff.
So again.. any updates?

Just recently his brother died of natural cause. His brother has no wife and children leaving my friend to be the closest relative. Since the death of the lessee would make him default. and the car is still on the lease term. Is there an option for him to continue the payments? since usually if the lessee dies ,the toyota guys will get the car. Really appreciate your replies, thank you.
