    Yes Lto form no. 3, that is the certificate of registration.

    Much better Sir if you visit them personally, and if necessary magsama ka ng mas nakakaalam ng ganyang process. You dictate the tempo sa conversation, since property mo yung unit virtually. But do not give them the original OR/CR pag sinabing iwanan mo na lang at balikan, unless may written document na kayo signed by both camps.

    mga sir pwede po ba magtanong?

    bibili po kasi ako ng second hand car, humingi po ako ng photocopy ng OR - CR para ipaverify sa TMG kung malinis yung car. malalaman ko po ba sa clearance kung bayad na ng buo yung car?

    tsaka nakita ko po sa photocopy ng CR sa box ng ENCMBERED TO ay may nakalagay po na number. 12 digit number, (something like this 000-000-000-000) ano po ba ibig sabihin nun?

    2. Okay lang bang iparegister ko na lang yearly yung sasakyan at di ko na patanggal yung "Encumbered" sa COR? Medyo magastos at mahabang proseso pa kasi. Tutal wala naman akong balak ilabas ng EDSA ang sasakyan, pang-nearby lang kung baga.
    kung gusto mo ganito na lang gawin mo para may peace of mind ka. verify mo kung fully paid na and verify mo din kung walang alarm na carnapped yan. Kung ok pareho, you can continue using the car and renew it as is. pwede mong gamitin kahit saan yan, walang gaanong magiging problema.
    Mga sir, any updates on this? Ganito din ako, yung hawak ko na CR ay encumbered status pa... Pero nasa akin nadin yung OR, deed of sale, resibo from seller, at release of mortgage/financing. Unfortunately hindi nilakad nung bangko at seller sa registry of deeds. Plano ko po na i-renew nalang as is, malapit narin ang renewal, at next time ko nalang i-transfer sa pangalan ko o ipatanggal yung encumbered sa CR (change to "owner's copy"), I just texted LTO at wala naman apprehension, etc. Baka may ma-advice kayo.... Salamat po.

    Pahabol: Orig OR CR lang po ba kailangan ko dalhin sa LTO? First time ko kasi magparenew na ako lang. Dati kasi sa mga dating sasakyan namin (puro segunda mano din) meron pong tumutulong sa paglakad.

Salamat po. - - Its better na isabay mo na lang sa renewal mo ang release of mortgage, tsaka transfer sa iyo, para isang pasada lang. Costwise, it will just another P1k tops kasama na annotation sa Registry of Deeds ng Cancellation of Mortgage. I have encountered a lot of cases where di pa nalilift ang encumbrance, at di na nila makita ang cancellation of mortgage. Yung tipong wala na sa existence ang bangko (say Great Pacific Savings Bank or Philam Savings Bank at di na malocate ang records). Its a bit of a hassle but its better to be safe than practice procrastination.

    what if hinde talaga e bigay sa lending company? kahit full paid na.
    ganito din ang problem ko ngayon. parang illegal yung lending company.
    2 owner ako.

    Baka meron po may alam kung ano pwede ko gawin. *** nabili ko po na auto ay may mark na "encumbered china bank P1,050 then may nakapatong na 000-000-000-000". 1st owner po is ADB which is paid in full kase wala po nakalagay na "encumbered", then may 2nd owner and 3rd owner. So pang 4th owner napo ako. According to the 3rd owner, since ADB ang 1st owner, Tax free daw po and fully paid. Pero nung tinransfer napo sa 2nd owner (private), the 2nd owner needs to pay the taxes na hindi naicharge sa ADB as policy ata which had been paid by the 2nd owner to Chinabank with xerox proof of deposit slip and BIR Certificate.

    Pagdating sa 3rd owner which is under a company name, nakalagay parin po yung "encumbered chinabank P3,950 then may nakapatong na 000-000-000-000" which is mas mataas na po ang nakalagay.

    Nakapagtataka lang po kase yung amount na nasa "encumbered chinabank (amount)" is the exact amount na binayaran ng 2nd owner and yung nasa BIR Certificate which is P1,050 & P3,950

    And sabi nung 3rd owner (representative nung company) baka yung encumbered daw po yung sa TAX.

    Ang pagkakaintindi ko po kase pag sinabi na encumbered, ginawang collateral ang auto or may utang ang tao na nakalagay sa OR/CR at yung TAX na dapat bayaran ay walang connection sa encumbered. Hindi mawawala yung encumbered kahit nagbayad na ng TAX. Tama po ba?

    Nakapagtataka din po na naililipat ng mga previous owner sa kanila yung OR/CR kung kailangan pa ng "cancellation of chattel mortgage"

    Meron po ako kopya ng mga OR/CR ng lahat, pati mga Deed of sale from 2nd owner to 3rd owner then to me. Board resolution ng 3rd owner.

    Gusto ko npo mailipat na saken ang pangalan ng sasakyan without encumbered on the CR. Ang problema ko po wala po maibigay na "cancellation of chattel mortgage" and 3rd owner dahil wala din daw po naibigay sa kumpanya.

    May nakapagsabi po saakin na OK lang naman daw po yung may encumbered as long as may Deed of Sale. Pero hindi maililipat sa pangalan ko and pagnagkaproblema, malaking abala sa korte.


    Added questions:
    1. Nageenternatain po ba ng banko like chinabank na icheck yung record ng sasakyan kung ginawang collateral or may utang ang previous na may ari or kung ito ay bayad na?
    2. Kung bayad na siya sa lahat ng obligasyon, since ako napo ang current owner, pwede po kaya ako makahingi ng original na "cancellation of chattel mortgage" sa banko?

    First off, kung hawak mo na orig CR, most likely tapos na bayaran loan niyan. So first step mo talaga is alamin kung bayad na ba o hindi pa. If not laki problem mo, technically "hot car" yan pero i doubt it.

    If bayad na, there is a thread here earlier ang problem ay di na din malocate ang original owner ( pls look for it ganoon dinkasi route mo). What you need is a certification na hindi na malocate ang original owner, and an affidavit of warranty for you to be able to transfer said vehicle to you. There is a legal remedy kung talagang walang problema ang ownership history ng unit.

    well kung clean ang papers, medyo nasa safe side ka na. Worst case scenario lang is kung bigla lumabas ang original owner and bigla i assert ownership niya. may chance na matalo ka dun.

    Good day sir! May I ask what remedy available if hawak mo na yung Original OR/CRE and Release of Chattel Mortgage, kaso wala po records sa registry of deeds yung unit. They advised mo to get new copy of release chattel mortgage sa bank. Allowed po ba na makakuha ako ng copy kahit nasa akon na sasakyan (with deed of sale)?
