need advice on car accident, steps to do after

hi, just registered, may nagrecommend sa akin na dito ko daw post yun question ko... i tried my best looking for the same situation using the search function pero wala ako makita... please be gentle to me hehe.

just had a car accident in SLEX, nag left turn ako to switch lanes then yun bus eh sinuyod ako.

so ngayon lumalabas ako yun wala sa lugar kasi nasa tamang lane yun bus. the problem is, traffic sobra nun, at nakahinto lahat halos, when i was about to switch lanes, nagsignal ako syempre, then i saw the bus na malayo pa and naka stop, as in full stop. kasi pinakiramdaman ko muna bago ako lumiko, so naka stop nga sya. (naisip ko tuloy kung diredirecho na lang ako nun time na yun at mabilis eh di sana ako nabangga)

nagulat na lang ako kumayod na sya sa side ko sa left, tas gang sa nakaladkad yun kotse.

ito ngayon sa police report, ang sinabi nila eh meron daw akong iniwasan na kotse sa right ko, kaya ako humampas sa bus, side-by-side daw ang banggaan. pero syempre di ako pumayag, kasi di nga ganun nangyari.

yun pulis naman, nagulat kasi magkaiba kami ng statement nun driver ng bus, so after makuha statement namin, tiningnan na yun damage ng kotse (hinila na kasi yun kotse ko papunta sa police station para di nakaharang, bale meron na lang sketch). nagtataka sya ngayon, kasi imposible nga daw na side by side, kasi ang bangga sa akin eh from the back of the car papunta sa harapan.

eh pareho kami na naka TPL lang, so mahirap nga daw yun sabi ng police. panu daw ang gusto namin mangyari, kung pagusapan na lang daw ba namin ng driver ng bus, or direcho namin sa court.

so di ako pumayag, kasi nga ako yun binangga. though may fault din daw ako nun kasi switching lanes ako. kaya ayun ang ginawa eh tiniketan ng pulis yun driver ng bus, tas ako kinausap muna. tas nun, sinabi nya na badtrip daw sya sa driver nun bus kasi nagsisinungaling, imposible daw yun sinasabi ng driver nga na ganun. pero ayaw pa nya sabihin kung ano lalabas sa police report. tas di na ako tiniketan. take note walang lagay na hinihingi ha. as in sinabihan lang ako ng gagawin ko(salamat naman at may pulis pa na ganito). so sa monday daw yun police report balikan ko daw. sa kasamaang palad, sa sobrang tuliro ko nun mga panahon na yun eh nakalimutan ko lahat ng sinabi nya na importante.

mga tanong ko po:
1. paano ang habol ko sa bus driver? anu ang next step ko, hanap na ba ako ng lawyer?
2. pano kung favorable sa akin yun police report, na di ako ang may kasalanan, enough na ba yun para magbayad yun bus company sa akin?
3. dumaan ako sa honda kanina, malaki daw magagastos mga 50-100k daw. eh onti na lang halaga na yun ng kotse ko eh hehe. kung favorable sa akin ang police report pede ba ako bayaran ng insurance nun bus? kahit pukpok lang sa mga talyer pede na sa akin hehe. (baka may marecommend kayo talyer din dyan, paki pm naman ako. )
4. gaano katagal ang mga kasong ganito? kasi kung mas malaki pa magagastos ko sa paghabol sa bus driver, kesa sa pagpapagawa ko ng kotse, eh ipapakulam ko na lang yun driver hehe.
5. may idea ba sa gastos sa legal side? attorney's fee, etc? pede ba ang PAO dito?
6. any advice para di na ito umabot sa court? from what i heard sa ibang tao na nakusap ko, eh pahirapan daw kapag bus company ang kalaban. ayaw kasi makipag settle nun driver eh. pede ba yun bus company mismo kausapin ko para makipag settle?
7. ano ba ang effect ng police report sa mga cases na ganito? specially kung favorable sa akin yun police report, san san ko sya magagamit? (following up with TPL ng bus, or pag hingi ng danyos sa bus, leverage sa isang settlement, etc)... and paano din?

Kung nakausad ka sa next lane tapos binangga ka eh IMO, kasalan ng bus yun kahit lane pa nya. Ikaw naman ang bingga sa side so un na lang eh ebidensya na. Pero hindi mo nga rin naman kasi linya yon so may laban pa yung bus driver. Pwede niya sabihin na bigla ka nagswerve t hindi ka na niya naiwasan.

Natural todo depensa ang bus driver (baka kasi matanggal din siya sa trabaho). Kasi kahit mali puwede niya ibaluktot makaiwas lang sa asunto. Maganda siguro dalhin mo yung police report sa bus company mismo. Best to talk this over with bus officials bago ka magfile ng kaso.

There are huge repair costs to think about. But also think about the "hidden" costs of your sleepless nights, abala (disruptions to your normal work and family activities), etc na hindi mo naman kayang imeasure in monetary terms. Exhaust mo muna lahat ng possibilities.

Malaking bagay ang police report since required ito sa mga legal claims (insurance, etc). But be vigilant. Baka mabaliktad yung nilalaman ng report at ikaw pa lumabas na mali.

If all options fail, just go to your trusted talyer at ipapukpok mo na lang ng hindi ka mabangga ulit ng casa. Then leave it to experience. Hindi mabibili ang peace of mind.

actually nakapasok na ako dun sa lane, natulak na lang ako palabas ulit ng bus hehe. kasamaang palad ulit, di ko nasabi sa report ko yun ah... iba talaga kapag nasa sitwasyon na ganun, dami makakalimutan, dagdagan mo pa ng pagiging tanga hehe.

nakapunta na ako kanina sa talyer, ang estimate eh 26k lahat lahat na. nagtataka lang ako, yun side mirror eh 8k. ganun ba talaga kamahal yun? 95 civic esi yun kotse ko.

sagabal sobra hehe. kaya kahit di ako mabayaran ng bus company, matanggal lang sa trabaho yun driver na yun. at kung possible na mawalan ng lisensya eh ganun sana.

sabi nga pala ni mang raul na kapitbahay namin (banggitin ko na pangalan para pag nagkita kayo eh feeling close na hehe), eh wag ko muna daw ipaayos yun kotse, estimate lang daw muna. kasi kapag pinaayos ko na yun mas mahihirapan daw ako mag claim sa bus company. eh ako naman, gusto ko lang maayos na ito, abonohan ko na nga lang yun pagpapagawa eh. kaso, takot ako baka totoo yun sinasabi ni mang raul, na di na ako mabayaran, wala ng reimbursement sa bus company.

that is why it's prudent for us car owners to get a comprehensive insurance for our rides.

kung TPl din yun bus wala rin makukuha, it's either bayaran ng driver or ng bus owner but I doubt it kung gagawin ng driver and owner yan. magtuturuan lang yun mag-amo

di na kasi ako nag compre nun, 10+ yrs na yun kotse nun nakuha ko, tas wala ng tumanggap sa akin hehe.

eh TPL lang din yun bus, so yayaman na naman ang aking experience nito, charge ko na naman kay experience eh hahaha

eh may idea ba kung pano ko ma-push man lang na mabigyan ng accountability yun bus driver? kahit dun man lang mabigyan ako ng satisfaction. mawala lang sa kalsada yun bus driver na yun.

Makipag negotiate ka na lang. But be warned na hindi mo makukuha lahat ng gusto mo. Just come to an agreement (and a compromise). It' d be better than not getting anything in return. You can wait forever for that reimbursement but its up to you kung kaya mong wala munang service. Pwede nyo paghatian ang cost kung yon ang best way to settle things.

For sure nobody wanted that accident to happen. I have no sympathy to those bus drivers who rule our roads with impunity and its time for them to be taught a lesson or two. But to wish the driver to lose his job would mean adding undue suffering to his family as well. Just be thankful nothing serious happened to you. If I were in your situation, I'd wish the same thing to the driver but I'd still reconsider my actions for humanitarian considerations. Hindi rin biro ang perwisyo na binigay sa iyo but just be thankful that you are richer in experience, not with enemies...hehehe. At least na test yung patience mo. Kung sa ibang barumbado sa daan nangyari yan..baka hindi na buhay yung bus driver ngayon.

yeah all i was hoping for is at least 50% of the cost of repairs be shouldered by the bus company. kasi sa mga napapanood ko sa tv at napapakinggan sa radyo, eh hinayupak talaga yan mga bus companies na yan sa mga kasong ganito. pero i dont expect to much kaya ito ako na lang gagastos lahat.

about the driver losing his job, though others might see me as mean or masyadong masama na. pero if that is what it takes for him to own up to his mistakes then so be it. in the first place di naman mangyayari ito kung di nya ako inararo. napagkamalan siguro akong kalat sa kalsada kaya ako winalis ng bus nya haha.

but seriously, he should have thought of that bago ako binangga. i agree na di nya naisip to. pero lahat ng actions natin ay may consequences. ako din sa trabaho ko, kung sumablay ako, malamang tanggal ako. and thats why i do my best for that not to happen. buti na lang nga at mabagal ang takbo nya nun kasi pahataw pa lang sya siguro. buti na lang ganun lang ang nangyari sa akin. but still that doesnt make him less accountable. kung mawalan sya ng trabaho, at magutom family nya, it is his own doing na din. kasi kung namatay man ako or naparalyze or kung ano man na makapag prevent na masuportahan ko ang family ko, paano na sila ngayon...

hay buhay nga naman, but i agree, malaki ang gagastusin ko dito at para na ako nakipag usap sa pader for the reimbursements. hehe. buset... hahaha

Based on your statement, what you could do are:

1. File a formal claim against the bus company and driver;
2. Don't expect a reply;
3. Send a follow up letter;
4. Again, don't expect a reply;
5. Then, send the final demand letter informing that you're going legal.
6. Again, don't expect a reply;
7. Endorse the case to a lawyer but check if you can afford it and willing to undergo the hassles of protracted litigation. Otherwise, charge to experience.

Next time, try to avoid or drive farther from PUVs. Dito sa Commonwealth, mga astig ang mga bus na yan. Andoon na ako sa inner lane para malayo, bigla may bumubusina ng sunod sunod at nasa likuran ko na pala.

update:
just got the police report, and in favor nga sa akin. wala negligence on my part, pero dun sa bus driver meron, inattentiveness daw hehe.

so tumawag ako sa bus company, tas kinausap ko yun manager, una ingles ako, tas mabait naman, ngayon pa lang daw nila nakita yun report and di pa dumadating sa main office nila. tas nun tinanong kung sino ako, sinabi ko ako yun driver na nabangga nun bus nila, bigla sabi eh patitingin sa legal department nila hehehe. so mukang ito na yun, bitinan time na.

at least meron kahit papanong sign na takot din sila sa asunto. nakapag loan na ako para sa repair ng kotse, and nakahanap na ako ng sponsor din para tulungan ako sa legal issues kung sakaling umabot dun. ang sabi lang ni sponsor eh maghanap na daw ako ng lawyer, so baka may kilala kayo na lawyer dyan tungkol sa mga kasong ganito.

tsaka kung meron kayo idea sa PF nun lawyer, para masabihan ko na din si sponsor, baka sakali iwan ako sa ere kapag nalaman magastos pala hehe. at least bago ako magtapang-tapangan eh malaman ko na agad kung tutuloy ko yun case if ever umabot sa ganung punto.

newbie ako dito and busy mostly sa pag babasa ng mga threads, however, when i stumbled upon your post, i was compelled to share my inputs since we have experienced very similar predicaments. Hirap lang ako mag post dito dahil sadyang napaka-hirap mag open ng tsikot site (not sure kung connection ko or server nila). Anyways, like i said, same din naranasan ko late last year and sa SLEX din, my car was hit full force by a bus moving at top speed (tumilapon tlga ako sa kabilang lane!) so total wreck ung likuran ko. It was a miracle of some sorts that i survived, but also i have to give some credit to the strength of my car's body. Ito pa, pagkabangga sakin ng bus, tumigil lang sha saglit, like the driver was checking to see any signs of movement from me. When i came to from the shock, i stormed out of my car and approached the bus. Itong tangang driver natakot ata sa laki ko, tinakbo ung bus!! So what do we get now?? HIT AND RUN!! The whole case was in the bag for me, pero bago ako nakapg file ng complaint, the bus liner people offer to settle nlang for the damages based on the cost ng estimate na mukukuha ko sa casa. Wrong move ako dahil kinagat ko offer nila to wait for their settlement. Days, weeks and then months passed and still no settlement. Bawat follow-up ko, ang sagot lang ay "sir, nasa management na ung settlement, wala pang feedback..." I got fed up and decided to file a case sa makati. Ninong ko sa kasal ung lawyer ko so i got that part covered. Ang diskarte namin is to file a criminal case against the driver, then use that case in reference to a follow-up suit against the bus company. Tapus whatever makuha, sana enough to cover for both repair expenses as well as legal fees.

Now, here's the most important thng i'd like to share with you, should you decide to file a legal case: Make sure you got a bucket-load of patience in you . The legal system works at lightspeed of paces (sarcasm) It took almost 9 months for my case to get off the ground, and i made several visits to the prosecutors office in between. Pahirapan tlga daw pag mga bus liners, and mahilig tlga sila sa "no-show" which just makes the case proceeding even much harder .

I hope that all goes well for your case and you don't have to go through what i have gone through. Some cases are worth the effort for the price of justice and retribution, the rest is simply charged to experience lang talaga.
