Senate Bill 2464, also known as the Lemon Law, which seeks to protect buyers of new and secondhand vehicles.
Under the proposed measure, a car is described as a “lemon” if, during the Lemon Law Rights period (18 months for brand new cars), it has been under repair three or more times yet the same defect continues to exist; the defect is a serious safety defect and has been subject to repair one or more times; or it is out of service due to repair for a cumulative total of 30 calendar days.

SENATE OKAYS LEMON ACT OF 2007
The Senate approved on third and final reading Monday night a legislative measure that would protect the rights of consumers who had the misfortune of buying defective cars and which will compel automobile manufacturers and dealers to immediately repair the defects or, if necessary, replace them with comparable vehicles.

Thanks for this information and it will defintely help us out in our persue for a unit replacment... So timely lang na-approve itong bill na ito...
Dedeypi, Chilun and the rest of the group...
We can use this law in our favor...
As of now my other ka-innovas who has the same problem namely Ampy, Barny and Chilun and Sgt Pepper, will it be ok if we meet again to talk about our next step? Although our innovas are located and service on different dealers and that iba iba na ang repairs and steps na ginawa, Like mine is currently at ortigas dealer and after changing the turbo system, wala padin ginagawa sa unit ko. I left my unit there last tuesday and feedback is that TMAP will be evaluating my unit and based from their initial recommendation, kailangan daw palitan yung catalytic converter but apparently wala pa yung bagong design so i still have to wait for it. Good thing they gave me a service unit pero i am still pushing for unit replacement. I already gave my letter to TMP and emailed it to Ms Josephine Villanueva. Kapag lumabas unit ko sa casa, ill have it emission tested for back up proof for DTI letter...
I suggest that we have our unit emission tested and then have both a petition letter signed by us and an individual letter stating your experience with the unit. We have to take all angles.
What do you think? Any suggestions pa?
Chilun, dedeypi and sgt pepper you already know my cell number... whats you plan?

yesterday, i went to TSI, i gave them a copy of my demand letter and according to them wala paring feedback from TMP if they will replace our unit.i think we should prepare our petition letter so we can send it to DTI already. Para naka pila na tayo sa kanila, alam mo na gov't agency yan baka matagal ang processing time nila.
just to let you know, according to ampy, TMP informed him that in case TMP decided to replace our unit they might depreciate the value of our car. ang labo diba... tawagan nalang.

Depreciated value? Maybe they are treating this as if its a trade-in deal. If that is the case, then that would be very inappropriate of TMPI.

September 28th, 2008 09:35 PM #88yup it was also what they said to me... kainis tlaga sila!!! kala nga siguro nila trade in... dapat nga they have to pay us including damages, just imagine the hustle and time wasted just to bring in our unit. Tapos ngayon parang what TMP is doin is they are buying some time since they still dont know the problem... upto now wala padin gumagawa sa unit ko at naka tegga lang sa ortigas. They are waiting daw for TMAP to evalute...
Im just waiting for the letter of Ms Villanueva and i will include that with our file for DTI
Bahala na DTI...

It should not be depreciated value, as it is not to be liken to Insurance claim nor to be taken as if you are selling back your car to them. You are claiming warranty and has the right to demand a full replacement of defective unit.
Fellow Innova owners, I hope you all get through with all these headaches, and I am confident that this will also benefit TMP and other D4d owners in pursuing quality services.

Our problem is still not solve pero bahala na DTI....
