    This might pose a problem when you apply for a loan. You might be indicated in the CMAP list. Pay it in terms na lang and get a clearance after. You might get a subpoena pa if you delay it. My two cents.

    YUp correct you will be positive at CMAP... because of the demand letter from the telco company.

    mas maganda po... if you could write a letter to the credit dept of the company, do tell them that you will just pay for the amount na paunti unti... pero mas maganda pa rin talaga if ireconnect mo yun para ma waive yung pre-termination fee. tapos tapusin mo nalang yung kaunting buwan na natitira para cleared ka..

    per Philippine Constutution : No person shall be jailed in non-payment of debts or poll tax. In Civil law, that is only a civil case for sum of money.
    different kung estafa or if you've issued bouncing checks. it is still under the Penal Law, which, you can be arrested or jailed.

    As a seasoned credit professional, medyo natatawa ako sa ibang statements dito.

    Waived off does not automatically mean wala na yung utang mo. There is no such thing as waiver of debts in accounting books, pero merong write off. Meaning, hindi na recognized as accounts receivable (or notes or loans receivable) yung utang on the part of the creditor, pero pwede pa ring singilin yung sa borrower. Pag nagbayad yun, it is recognized as "other income."

    The only limitation is kung over 10 years na yung utang, and in that time, walang demand letter or statement of account na natanggap ang borrower. That is the only time that the debt will be extinguished. But of course, only the court (if a case will be eventually filed), can make that distinction.

    Re: freezing of bank accounts, only the Anti-Money Laundering Council and the courts can order that. Pero in order to do that, kailangang mag-file muna ng motion ang creditor, and engagement of lawyers and filing motions will cost money. If going through all that is deemed economically unfeasible, the creditor may simply write off the debt. Pero there are times na kahit maliit yung amount, tinutuluyan pa din sa korte just to teach the borrower a lesson. I've attended court hearings where credit card companies sued some borrowers for less than 20k. Baka arogante yung borrower na yun, kaya kinasuhan.

    Been there, done that.

    Kahit naman magdemanda bank eh ano mapapala nila? Talaga naman may utang yun CC holder eh...

    Baka nga lamang pa yun may utang dahil sabihin ng judge na 1-2% na lang interest start from the day when they defaulted and hinde compounded interest singilin ng bank

    Saka bago dumating yan sa judge dami pa mediations.

    The cases were filed before the enactment of the Small Claims Court. I've been attending our own cases filed in 2002, until now, under litigation pa din sa QC MTC.

    And pwede na silang kasuhan under the Access Devices Regulation Act (RA 8484), under the provision na lumipat sila ng bahay without informing the credit card company. Criminal case yun, and not simply a civil case for Sum of Money.

    We also file BP 22 cases sa ilang mga borrowers namin to teach them a lesson, kahit less than 50k, kasi criminal yun in nature, so may arrest warrant. And we make sure to transmit the court records to the credit bureaus to restrict their access to credit. And since automatic naman na pinapadala ng korte yung list of records nila sa NBI, then magakakaroon din sila ng NBI record, eh di mahihirapan silang maghanap ng work. Sometimes, kahit hindi kami mabayaran, basta may kaso sila, masaya na ako. Maybe ganun din yung aim ng bank.

    Some borrowers kasi, sila na nga ang may atraso, sila pa ang mayabang. I've personally slapped the handcuffs on some of our arrogant borrowers (may kilala na kasi kaming pulis from the QCPD Warrant Section), and the feeling is priceless.
