    Some borrowers kasi, sila na nga ang may atraso, sila pa ang mayabang. I've personally slapped the handcuffs on some of our arrogant borrowers (may kilala na kasi kaming pulis from the QCPD Warrant Section), and the feeling is priceless.
    Diba decriminalized na bP22?, nag kakaroon lang ng arrest warrant if creditors don't attend their hearings...so no choice judge but to issue arrest warrant, but as long as yunmay utang attend the hearings, there will be no arrest warrant...

    Most often than not kasi eh mga creditors ng CC wlang panbayad ng lawyers but if malaki utang and kaya kumuha ng lawyer, I don't thnik meron makukulong sa BP22, meron naman bail eh..

    I'm reading yun RA na sinabi mo, meron word na "surreptitiously"...I think lang for me, it's hard to prove na creditors left their place or work "secretively"...I think an average lawyer can easily throw beat that provision na yan..

    Saka I think mga naghahanol talaga yun maliliit na lending institutions but these amounts are Patsy's for banks...

    Sample yun byenan ni mikey arroyo, meron ng writ of execution para sa eviction dahil na foreclose na ng BPI bahay nila sa Forbes park, Kahit pumunta na yun sheriff and all hinde pa rin nila mapaalis...

    Nope, BP 22 has not been decriminalized, contrary to public perception. Criminal pa din siya, since only Congress can repeal that law. May exhortation lang ang Supreme Court na huwag ng bigyan ng prison term ang accused, pagbayarin na lang. Ang problema madalas eh, wala namang pambayad.

    And regarding arrest warrants, you'd be surprised to know kung ilang accused ng BP 22 ang hindi uma-attend ng hearings or arraignment. So they remain at large. Tapos pag pino-posasan mo na, humahagulgol. Kaya lang, manhid na ako eh, hehehe.

    And as I said, in some cases, kahit hindi na kami mabayaran, basta masampahan lang namin ng kaso at magkaroon ng record, ok na. So we file cases kahit below our internal limit of 50k.

    As to "surreptitious," I think it's easy enough to prove. Kung hindi mo pinaalam sa creditor na aalis ka , and nobody in the household knows exactly where that borrower is now staying, then he is, in my view, deemed to have violated the law. Implied kasi yung intention mo na ayaw mo nang bayaran yung utang (if the loan is deliqnuent).

    Pero tama ako diba? As long as mag attend ng hearings walang arrest warrant, kaya nga si cristy fermin hinde nakukulong eh...hehehe

    Kaya mahirap magpautang ngayon, kanit meron pang PDC...ang dami daming process bago makasingil.

    Sana meron lawyer na magbigsy ng input about doon sa "surreptitiously" na word ng RA...

    I'm not a lawyer pero parang masyadong vague for me yun word, open for interpretation...ewan ko bakit sinama pa kasi sa RA?

    BTT:

    Pag hindr talaga na kayang bayaran yun cellphone bills, which hinde ko alam Kung bakit hinde kaya dahil hinde naman siguro hundred of thousand ang bill...but pag hinde talaga kaya, then move on... Mag prepaid na lang kayo.

    well the responds are debts on banks and for credit cards... does, this scenario similar on unpaid postpaid bills also?

    More or less, account will be collected probably by telecoms external collection agency as well...but I don't think telecoms will go all out just to collect patsy amount of money...they'll just move on.

    i worked on a telco before, i might say "sindakan" na lan ang laro kapag umabot sa korte. Nagulat kasi ako dati minsan napuno bodega namin ng mga used appliances. Pinangbayad, or say pinull-out daw nila sa mga hindi nakapagbayad (of course with court's clearance).



    Pinagtataka ko naman:

    GLOBE - me bad account ako 2004 siguro, then came 2006 ginawa akong ext ni GF (wife now) until today gamit ko pa rin. I was wondering for all this time whenever i complain - dala ko fullname ko, which they can trace back with my old account. Pero dahil good credit standing siguro asawa ko since late 90's kaya hindi na ako pinansin?

    SMART - bad account ako 2005 ata, late last year napasubo ako kumuha ng LTE plan. Lumabas yun name ko, but i was vouched by my VP friend. Sya din kasi nagpumilit sa akin kumuha. Hehehe.

    kung di sa iyo nakapangalan yung account na ginagamit at sa asawa mo naman, ayos lang. and did you payed ba or you just let it lang?

    OT: me alam ako kalokohan dyan, majority sa mga mobile carriers' subscribers are prepaid. Sabihin mo na lang PISO "nakaw" load sa 1M subs per day? Who would even care sa prepaid user na nawalan sila ng PISO? maygulay.
