Two women lawmakers on Thursday pressed for amendments to the county's laws on marital infidelity to correct the seeming disparity in the treatment of husbands and wives.

Representatives Imee Marcos of Ilocos Norte and Liza Maza of Party-list group Gabriela said they filed House Bill 334 to update the laws on marital infidelity and make them more applicable and equal for both ***es.

The bill seeks to amend Articles 333 and 334 of the Revised Penal Code that penalize adultery and concubinage. Under the Code, the wife is meted a heavier penalty for a single act of infidelity.

Marcos said there is a perceived disparity in the treatment of husbands, on the one hand, and wives, on the other, insofar as the imposable penalty is concerned. She said the bill provides for a definition to "marital infidelity" and to provide the penalty for the offense.

Marcos told ANC in an interview that Articles 333 and 334 were made when wealthy families were afraid to share their lands to illegitimate children.

She also pointed out that on the present set up, the mere suspicion that a woman was having an affair with another man could make her liable for adultery, contrary to the higher legal requirements needed to pursue a bigamy or concubinage case against a man.

"Hindi katulad ng sa lalaki na kailangang makitang iniuuwi niya sa bahay, or nahuling nakikipag-do in public place, or nakitang iginagarahe o kaya ay ikino-condo, napakahirap namang kumuha ng ganyang pruweba " said Marcos.

She added that there should be an evidence of carnal knowledge before an individual be made liable for infidelity.

"There are many levels of infidelity that takes place and that ***ual intercourse is just one of them," said Marcos.

For her part, Maza said that the proposed amendments are designed to strengthen the rules of evidence on infidelity cases.
